AN ORDINANCE <br />. AUTHORIZING THE ABANDONMENT OF CERTAIN EASEMENTS <br />OVER PROPERTY OWNED BY INOVA CORPORATION <br />ON AVON STREET EXTENDED. <br />WHEREAS, the Inova Corporation, the owner of property located on Avon Street <br />Extended, has requested abandonment of certain existing easements acquired by the City, <br />described as follows: <br />(1) Easement for water line facilities, 20 feet in width, as shown on the plat <br />attached to the deed recorded in the Charlottesville Circuit Court Clerk's <br />Office in Deed Book 619, page 616; and <br />(2) General utility easement, 20 feet in width, and located on property <br />identified as Parcel 289 on City Tax map 58, currently owned by the <br />Inova Corporation, acquired by the City through the ordinance approved <br />November 1, 1993, to close, vacate and abandon Lyman Street, of record in <br />the Charlottesville Circuit Court Clerk's Office in Street Closing Book 2, <br />page 14. <br />• WHEREAS, in accordance with Virginia Code §15.2-1800(B), a public hearing <br />was held to give the public an opportunity to comment on the conveyance of these <br />easements; and <br />WHEREAS, the staff of Engineering and Public Utilities have reviewed the <br />request and determined that the City no longer has a need for the above-described <br />easements; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the <br />Mayor is hereby authorized to execute a Termination of Easement deed, in form approved <br />by the City Attorney, to terminate and abandon the above-described easements to Inova <br />Corporation; provided, however, that the easement for airspace occupied by the Belmont <br />Bridge and the right to maintain said bridge, which were reserved to the City by the <br />ordinance approved November 1, 1993, shall not be affected by this ordinance. <br />Approved by Council <br />October 2, 2000 <br />Mjgfrk of City Couticil <br />
