upon a fourth conviction within one (1) year of any offense under this section involving <br />is <br />the same dog, the defendant shall be deemed guilty of a Class 3 misdemeanor. <br />Sec. 4-41. Leashes required for dogs in certain areas. <br />(a) Notwithstanding other provisions of this chapter, dogs shall be kept on a leash and <br />under control: <br />(i) in all City parks (except for designated off -leash areas); <br />(ii) on the City's Greenway Trail system; Pet; 12", PAd <br />(iii) on the Meadow Creek Golf Course; <br />(iv) on the downtown pedestrian mall between the Ninth Street bridge and <br />Ridge -McIntire Road, and on all side streets between Water Street and <br />Market Street which adjoin the downtown mall; aad <br />(v) on all public school property; and <br />(vi) in all City -owned cemeteries. <br />Provided, however, that dogs in a sanctioned obedience or training show, trial, <br />class, or similar event held in a City park Pik shall not be required to be on a leash, <br />while they are actually participating in such an event, nor shall dogs be required to be on <br />a leash on specific days and in specific areas in the Greenbelt Trail section of Riverview <br />as may be <br />• (b) Any person who violates this section by failing to have his or her dog on a leash <br />in the areas so designated herein shall be guilty of a Class 4 misdemeanor; provided that, <br />upon a third conviction within one (1) year of any offense under this section involving <br />the same dog, the defendant shall be deemed guilty of a Class 3 misdemeanor. <br />Approved by Council <br />December 17, 2001 <br />le k of City Council <br />0 <br />
