AN ORDINANCE <br />• AMENDING AND REORDAINING SECTION 29-40 OF ARTICLE II, <br />CHAPTER 29 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1990, AS AMENDED, RELATING TO LAND USED <br />FOR PUBLIC RECREATION PURPOSES. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that <br />Section 29-40 of Article II, Chapter 29, of the Charlottesville City Code, 1990, as <br />amended, is hereby amended and reordained as follows: <br />Sec. 29-40. Lots - Generally. <br />(a) All lots shall contain a satisfactory building site which meets the requirements <br />of the zoning ordinance (Chapter 34 of this Code) and shall front on dedicated, accepted <br />and improved streets which, when constructed by the applicant, will qualify for such <br />acceptance. <br />The foregoing requirements do not apply if: <br />Such lot is to be conveyed to the governing body for open space, recreation, <br />• or conservation purposes only, and the plat contains a notation that no <br />building permit shall be issued for the lot unless it is combined with another <br />parcel so that it gains frontage=or <br />Such lot is part of a planned unit development and is accessible by a public <br />access easement, is create for open pace, recreation, or conservation <br />purposes only and the plat contains a notation that no building permits shall <br />be issued for the lot unless it is combined with another parcel so that it <br />gains frontage. <br />Approved by Council <br />May 21, 2001 <br />le k of City Co ncil <br />
