AN ORDINANCE . <br />AMENDING AND REORDAINING SECTIONS 4-41 (LEASHES REQUIRED <br />• FOR DOGS IN CERTAIN AREAS) AND 4-42 (REMOVAL OF DOG DEFECATION) <br />OF CHAPTER 4, ARTICLE II OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that Sections <br />4-41 and 4-42 of Chapter 4 of the Charlottesville City Code, 1990, as amended, are hereby <br />amended and reordained as follows: <br />Sec. 4-41. Leashes required for dogs in certain areas. <br />(a) Notwithstanding other provisions of this chapter, dogs shall be kept on a leash and <br />under control in Pen Park; ineittding and the Meadow Creek Golf Course, on the downtown <br />pedestrian mall between the Ninth Street bridge and Ridge -McIntire Road, and on all side streets <br />between Water Street and Market Street which adjoin the downtown mall, and on all public <br />school property; provided, however, that dogs in a sanctioned obedience or training show, trial, <br />class, or similar event held in Pen Park shall not be required to be on a leash, while they are <br />actually participating in such an event. <br />(b) Any person who violates this section by failing to have his or her dog on a leash <br />in the areas so designated herein shall be guilty of a Class 4 misdemeanor; provided that, upon a <br />• third conviction within one (1) year of any offense under this section involving the same dog, the <br />defendant shall be deemed guilty of a Class 3 misdemeanor. <br />Sec. 4-42. Removal of dog defecation. <br />(a) It shall be unlawful for any person owning, keeping, or having in his care or <br />custody any dog, to fail, refuse, or neglect to remove any feces of such dog immediately and to <br />dispose of it in a sanitary manner whenever such dog has defecated upon the following described <br />property located within the City: <br />(1) Lee Park, jaekson Park, and MeGuffey Park; All city parks: <br />(2) The Meadow Creek Golf Course; <br />(3) The Rivanna Greenbelt Trail• <br />(4) The Downtown Pedestrian Mall from Ridge -McIntire to the Ninth Street bridge, <br />including the East End amphitheater, and an M other publiely inaitttained and <br />paved sidewalks, streets, atid bieyele path -s; <br />(5) Regularly maintain All public school property; and <br />(6) The property on which the Albemarle County Court Houses and the Albemarle <br />County Office Building are located <br />(7) Any other publicly maintained rights-of-way and paved sidewalks, streets, and <br />bicycle paths. <br />• <br />
