• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />AN ALLEY OFF THIRD STREET, N.E. <br />BETWEEN HIGH STREET AND EAST JEFFERSON STREET <br />WHEREAS, proper notice was duly posted and advertised that Court Square, L.L.C. would <br />request the City Planning Commission to initiate street closing procedures to close an alley off <br />Third Street, N.E., said right-of-way being approximately 10 feet in width and running a distance <br />of approximately 103 feet from Third Street, N.E. to its terminus, shown on the attached map drawn <br />by the City's Neighborhood Development Services Department; <br />WHEREAS, owners along this alley have been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and City Council was held <br />on January 9, 2001, and comments from the City staff, the Planning Commission and the public were <br />made and heard; and <br />WHEREAS, the Planning Commission recommended closure of the subject alley with the <br />recommendation that the approximate value of the alley right-of-way ($6,000) be requested from the <br />ISpetitioners; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the alley off <br />Third Street, N.E., running parallel to High Street and East Jefferson Street, described as follows, <br />is hereby closed, vacated and discontinued as a public thoroughfare of the City of Charlottesville, <br />Virginia, said alley not being needed for public use and travel: <br />An alley off Third Street, N.E. in the City of Charlottesville, <br />approximately 10 feet in width, running parallel to High Street and <br />East Jefferson Street, for a distance of approximately 103 feet from <br />Third Street, N.E. to its terminus, shown on the attached map drawn <br />by the Neighborhood Development Services Department, and located <br />on City Real Estate Tax Map 33 adjacent to Parcels 204, 205 and 206. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby reserves unto itself a <br />perpetual easement ten feet in width on either side of the center line of any water, gas, sanitary or <br />storm sewer mains presently located in the area being vacated, including the perpetual right of <br />ingress and egress over the vacated area for the purpose of installing, maintaining, repairing or <br />replacing such utility lines or mains. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this <br />ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street <br />. closing book. <br />Approved by Council <br />February 20, 2001 erk of CIO Council <br />
