AN ORDINANCE <br />• CLOSING, VACATING AND DISCONTINUING <br />AN ALLEY OFF CARLTON ROAD <br />WHEREAS, proper notice was duly posted and advertised that Carlton Property, LLC would <br />request the City Planning Commission to initiate street closing procedures to close an alley running <br />north from Carlton Road, said right-of-way being approximately 12 feet in width and running a <br />distance of approximately 150 feet from Carlton Road to its intersection with another alley located <br />perpendicular to the subject alley, shown on the attached map drawn by the City Community <br />Development Department; <br />WHEREAS, Carlton Property, LLC owns all the property contiguous to the subject alley; <br />WHEREAS, a joint public hearing by the Planning Commission and City Council was held <br />on November 14, 2000, and comments from the City staff, the Planning Commission and the public <br />were made and heard; and <br />WHEREAS, the Planning Commission recommended closure of the subject alley <br />conditioned upon the applicant relocating an existing private sanitary sewer line located within the <br />alley; and <br />WHEREAS, the applicant has complied with the Planning Commission's recommendation <br />• by providing a sewer pump system to serve the property which used the private sanitary sewer line, <br />and any existing easement for the private sewer line has been abandoned by instrument dated <br />August 3, 2001, of record in the Charlottesville Circuit Court Clerk's Office in Deed Book 824, page <br />851; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the subject <br />12 -foot alley, described as follows, is hereby closed, vacated and discontinued as a public <br />thoroughfare of the City of Charlottesville, Virginia, said alley not being needed for public use and <br />travel: <br />Alley off Carlton Road in the City of Charlottesville, approximately <br />12 feet in width and running a distance of approximately 150 feet <br />from Carlton Road to its intersection with another alley running . <br />perpendicular to it, shown on the attached map drawn by the City <br />Community Development Department, and located on City Real <br />Estate Tax Map 57 adjacent to Parcels 160, 161, 162, 163 and 164. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this <br />ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street <br />closing book. <br />• Approved by Council <br />November 5, 2001 C rk of City Council <br />
