AN ORDINANCE • CLOSING, VACATING AND DISCONTINUING AN ALLEY OFF CARLTON ROAD WHEREAS, proper notice was duly posted and advertised that Carlton Property, LLC would request the City Planning Commission to initiate street closing procedures to close an alley running north from Carlton Road, said right-of-way being approximately 12 feet in width and running a distance of approximately 150 feet from Carlton Road to its intersection with another alley located perpendicular to the subject alley, shown on the attached map drawn by the City Community Development Department; WHEREAS, Carlton Property, LLC owns all the property contiguous to the subject alley; WHEREAS, a joint public hearing by the Planning Commission and City Council was held on November 14, 2000, and comments from the City staff, the Planning Commission and the public were made and heard; and WHEREAS, the Planning Commission recommended closure of the subject alley conditioned upon the applicant relocating an existing private sanitary sewer line located within the alley; and WHEREAS, the applicant has complied with the Planning Commission's recommendation • by providing a sewer pump system to serve the property which used the private sanitary sewer line, and any existing easement for the private sewer line has been abandoned by instrument dated August 3, 2001, of record in the Charlottesville Circuit Court Clerk's Office in Deed Book 824, page 851; now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the subject 12 -foot alley, described as follows, is hereby closed, vacated and discontinued as a public thoroughfare of the City of Charlottesville, Virginia, said alley not being needed for public use and travel: Alley off Carlton Road in the City of Charlottesville, approximately 12 feet in width and running a distance of approximately 150 feet from Carlton Road to its intersection with another alley running . perpendicular to it, shown on the attached map drawn by the City Community Development Department, and located on City Real Estate Tax Map 57 adjacent to Parcels 160, 161, 162, 163 and 164. BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street closing book. • Approved by Council November 5, 2001 C rk of City Council
