Approved by City Council on February 5, 2001 <br />AN ORDINANCE to amend and reordain Sections 15-4 (General powers and duties of city <br />manager and traffic engineer as to traffic) and 15-149 (Procedure for parking violations; <br />• payment of fine without trial) of Chapter 15 (MOTOR VEHICLES AND TRAFFIC) of the Code of <br />the City of Charlottesville, 1990, as amended. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that: <br />1. Section 15-4 and Section 15-149 of Chapter 15 of the Code of the City of Charlottesville, <br />1990, as amended, are hereby amended and re -ordained as follows: <br />Sec. 15-4. General powers and duties of city manager and traffic engineer as to traffic. <br />(a) The city the traffic engineer, subject to direction and approval by the city <br />manager, shall have general supervision and control of the operation and parking of vehicles in the <br />interest of public safety, comfort and convenience, met imeensisten consistent with the provisions of this <br />chapter or and state law. <br />(b) The eity FRanager and t traffic engineer, subiect to direction and approval by the city <br />manager, shall have power to regulate traffic by means of traffic officers or traffic lights or other <br />signaling devices on any portion of the street where traffic is heavy or continuous, or where in their his <br />judgment conditions may require, and may regulate the use of the streets by processions or <br />assemblages. <br />(c) The eity fnenageF and t traffic engineer shall also have the authority may else, when <br />subject to direction and approval by the city manger, to: <br />• (1) Adopt sueh Fegulatmems not in eenfliet with the PFOVOSOeMS ef this ehapteF as they she I <br />PFOvided, that -sueh regulatiems she" met be deerned to be vielated Of, at the tinge of the <br />Fegulatien. Erect and maintain upon the sidewalks and streets of the city such signs, <br />signals and other devices for controlling traffic and for regulation of parking as he may <br />deem necessary. <br />(2) Require all vehicles to come to a full stop or to yield the right-of-way at any street <br />intersection other than vehicles on a street which has been designated as a part of the <br />primary system of state highways. <br />(3) Designate by appropriate signs or markers one-way streets and truck routes. <br />(4) Adopt such additional regulations for controlling traffic and regulating parking as he shall <br />deem necessary, and to repeal, amend or modify any such regulations. No such <br />regulations shall be deemed to be violated if, at the time of an alleged violation, any sign <br />or designation required under the terms of this chapter was missing, effaced, mutilated <br />or defaced so that an ordinarily observant person under the same circumstances. <br />would not be apprised of or aware of the existence of such regulation. <br />
