Prepared December 21, 2000 <br />• C:\MyFiles\Council\leander amended.ord.wpd <br />AN AMENDED ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF LEANDER AVENUE AND A 12 FOOT ALLEY <br />BETWEEN AVON STREET AND SIXTH STREET <br />WHEREAS, proper notice was duly posted and advertised that Mr. and Mrs. J. S. Barnett <br />would request the City Planning Commission to initiate street closing procedures to close: (1) a <br />portion of an undeveloped right of way platted as Leander Avenue, said right of way being <br />approximately 60 feet in width and running a distance of approximately 433 feet, and (2) an <br />undeveloped alley 12 feet in width, running 433 feet from Avon Street to Sixth Street, shown on the <br />attached survey drawn by Steven L. Key dated June 1, 2000 and revised June 7, 2000; and <br />WHEREAS, Mr. and Mrs. J. S. Barnett were the only property owners adjoining the rights <br />of way proposed to be closed; and <br />WHEREAS, a joint public hearing by the Planning Commission and City Council was held <br />on July 11, 2000, and comments from the City staff, the Planning Commission and the public were <br />made and heard; and <br />• WHEREAS, the Planning Commission recommended closure of the subject rights of way, <br />with certain conditions; and <br />WHEREAS, the subject rights of way were closed and vacated by City Council on <br />August 21, 2000, the Bametts subsequently conveyed the property to a new owner, and the new <br />owner has requested certain amendments to the previously approved ordinance; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that this Council <br />reaffirms that the following rights of way are hereby closed, vacated and discontinued as public <br />thoroughfares of the City of Charlottesville, Virginia, said rights of way not being needed for public <br />use and travel: <br />(1) A portion of Leander Avenue (platted but not developed) in the <br />City of Charlottesville, approximately 60 feet in width and running <br />a distance of approximately 433 feet from Avon Street to Sixth Street; <br />and <br />(2) a 12 -foot wide alley, running approximately 433 feet from Avon <br />Street to Sixth Street. <br />0 <br />
