• AN ORDINANCE <br />AMENDING AND REORDAINING SECTION 34-573 AND 34-681 <br />OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />RELATED TO IMPROVEMENTS TO PROTECTED (HISTORIC) PROPERTIES <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that <br />Sections 34-573 and 34-681 of Chapter 34 of the Code of the City of Charlottesville, <br />1990, as amended, are hereby amended and reordained, as follows: <br />CHAPTER 34. ZONING. <br />Sec. 34-573. Certificate of appropriateness. <br />(a) Required No changes in the exterior features or appearance of protected properties in <br />design control districts shall be made until the owner has first sought and obtained a <br />certificate of appropriateness from the BAR or, where applicable, from the director of <br />planning neighborhood development services. This requirement applies to: <br />(1) Any and all proposed demolitions on a protected property; and, <br />(2) Any and all proposed changes in the exterior features of protected properties <br />• visible from a public street or right-of-way including but not limited to,—_ <br />construction, reconstruction, alteration, restoration, encapsulation and relocation <br />of a protected building, structure, site or area: replacement of roof coverings and <br />installation or replacement of siding on any buildings or structures, and <br />replacement of windows and doors on any buildings or structures, regardless of <br />whether any such changes require a building permit <br />(b) Exclusions. The BAR shall not consider interior arrangements or features or structural <br />details which are not subject to public view from any public street or right-of-way. <br />Nothing in this article or section shall be construed to prevent: <br />(1) The ordinary maintenance or repair of any exterior elements of any building or <br />structure; or <br />(2) The construction, reconstruction, alteration or demolition of any such elements <br />which the authorized city officers shall certify as required for public safety. <br />Sec. 34-681. Design review. <br />All development requiring a building permit in the ECH Districts, and, regardless of <br />whether a building permit is required, any installations or replacements of roof coverings, <br />windows, doors, or siding on any buildings or structures, where such roof coverings, <br />• windows, doors or siding is or are visible from the arterial streets or.highways referenced <br />in city code section 34-671, shall be subject to administrative design review by the <br />
