Prepared August 7, 2001 <br />• First Reading: August 20, 2001 <br />AN ORDINANCE <br />AMENDING AND REORDAINING SECTION 34-96 OF ARTICLE III <br />OF CHAPTER 34 OF THE CHARLOTTESVILLE CITY CODE, 1990, <br />AS AMENDED, RELATING TO MEMBER COMPOSITION OF <br />BOARD OF ZONING APPEALS. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that <br />Section 34-96 of Article III of Chapter 34 is hereby amended and reordained, as follows: <br />ARTICLE III. BOARD OF ZONING APPEALS <br />Sec. 34-96. Composition; appointment and terms and removal of members. <br />(a) The board of zoning appeals shall consist of five (5) residents of the city, <br />appointed by the circuit court of the city. Their terms of office shall be for five (5) years <br />each, and the term of office of one member shall expire each year. The secretary of the <br />• board shall notify the circuit court at least thirty (30) days in advance of the expiration of <br />any term of office, and shall also notify the court promptly if any vacancy occurs. <br />Appointments to fill vacancies on the board shall be only for the unexpired portion of the <br />term. Members may be reappointed to succeed themselves. <br />(b) A member whose term expires shall continue to serve until his successor is <br />appointed and qualifies. Any member of the board may be removed for malfeasance, <br />misfeasance or nonfeasance in office or for other just cause by the circuit court, after <br />hearing held after at least fifteen (15) days notice. <br />(c) Up to three (3) alternate members to the board of zoning appeals may appointed <br />by the circuit court. The qualifications, terms and compensation of alternate members <br />shall be the same as those of reeular members. A regular member, when he knows he <br />will be absent from a meeting, shall notify the chairman twenty-four (24) hours prior to <br />such meeting The chairman shall select an alternate to serve in the absent member's <br />place and the records of the board shall so note. <br />Approved by Council <br />September 4, 2001 <br />L <br />rk of City Council <br />
