That Tenth & Main LLC deliver a recordable agreement, in form acceptable to the City <br />• Attorney, for the following: <br />11 <br />is <br />(1) Planning Commission approval to combine Parcel 42 with Parcel 41 and combine <br />Parcel 43 with Parcel 44 on City Tax Map 10 so the resulting lots would have <br />frontage on 101h Street, NW. <br />(2) Evidence of recordation in the Charlottesville Circuit Court Clerk's Office of an <br />agreement between Tenth & Main, LLC and the owners of property adjoining the <br />vacated right-of-way which would grant the adjoining property owners pedestrian <br />and vehicular access across the vacated right-of-way. <br />The fully executed agreement shall be delivered to the Office of the City Attorney, along <br />with a check payable to the Clerk of the Charlottesville Circuit Court for the amount of <br />the recordation costs.
