• AN ORDINANCE <br />AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED <br />IN SECTION 34-15 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, BY THE RE -ZONING OF PARCEL 85, CITY TAX MAP 37 <br />FROM "R-2" TO "PUD RESIDENTIAL" <br />WHEREAS, the Owner of Parcel 85, City Tax Map 37, has submitted an application seeking <br />a rezoning of said property from "R-2 Residential District' to "Planned Unit Development <br />Residential (R-2)", (hereinafter, the "Proposed Rezoning"); and <br />WHEREAS, a joint public hearing on this application was held before the City Council and <br />Planning Commission on January 15, 2002, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, on January 15, 2002 the Planning Commission voted to recommend the <br />Proposed Rezoning subject to certain conditions; and <br />WHEREAS, this Council finds and determines that the public necessity, convenience, <br />general welfare or good zoning practice requires the Proposed Rezoning; that both the existing "R-2" <br />• zoning and the proposed "PUD -R2" zoning classifications are reasonable; and that the Proposed <br />Rezoning is consistent with the concept and purpose of Chapter 34, Article X; Now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the District <br />Map Incorporated in Section 34-15 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-15. Zoning District Map. <br />Rezoning from R-2 Residential to Planned Unit Development (R-2) the property identified <br />as Parcel 85 on City Real Estate Tax Map 37, having approximately 550 feet of frontage on Madison <br />Avenue, and containing approximately 2.23 acres of land. This rezoning is subject to the following <br />conditions: <br />(1)No building or structure shall be erected, or building permit issued, or any lots sold from the <br />property subject to this rezoning, except in conformity with the approved plan of development and <br />until sufficient financial guarantees for required improvements have been approved by the City; <br />(2)If the present or future owner of the PUD designated area does not follow the approved site plan <br />for the project, then the remaining undeveloped property shall automatically revert back to the <br />original "R-2" zoning; <br />. (3)All residential units to be constructed within the PUD shall be designed for occupancy by not <br />more than a single (1) family. <br />
