AN ORDINANCE <br />• CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF CARROLLTON TERRACE RIGHT-OF-WAY <br />WHEREAS, proper notice was duly posted and advertised that property owners would <br />request the City Planning Commission to initiate street closing procedures to close a portion of <br />Carrollton Terrace Right -of -Way, said portion being east of Jefferson Park Avenue and Norfolk <br />Southern Tracks, approximately 150 feet in length laying between parcels 114, 115, and 131 on <br />Tax Map 16, shown on the attached plat and map. <br />WHEREAS, owners along Carrollton Terrace have been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and City Council was <br />held on March 12, 2002 and comments from the City staff, the Planning Commission and the <br />public were made and heard; and <br />WHEREAS, the Planning Commission recommended closure of Carrollton Terrace with <br />certain conditions, including payment of $15,000 to the City; now, therefore, <br />BE IT ORDAINED, by the Council of the City of Charlottesville, Virginia that <br />Carrollton Terrace, described as follows, is hereby closed, vacated and discontinued as a public <br />thoroughfare of the City of Charlottesville, Virginia, said street right-of-way not being needed <br />• for public use and travel: <br />Public right-of-way known as Carrollton Terrace in the City of <br />Charlottesville, located east of Jefferson Park Avenue at the Norfolk <br />Southern Tracks, approximately 150 feet in length, shown on the attached <br />plat and map, drawn by the City Department of Neighborhood Planning <br />and Development Services, and located on City Real Estate Tax Map 16, <br />lying between Parcels 114, 115 and 131. <br />PROVIDED, HOWEVER, that this ordinance shall not take effect until the City receives <br />payment of $15,000.00, the amount established to be the value of the right-of-way, from <br />Petitioner. <br />BE IT FURTHER ORDAINED that the Clerk of the -Council shall send a copy of this <br />ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street <br />closing book upon notification from the City Attorney that the above -referenced payment has <br />been received. <br />N.B. Pursuant to Virginia Code §15.2-2008, the City has demanded and received payment in the amount <br />of $15, 000.00 from 1730 JPA, LLC as the value of the right-of-way conveyed on this 31st day of <br />December, 2002, and this ordinance is hereby effective on December 31, 2002. <br />• Approved by Council <br />November 18, 2002 qle k of City Counbil <br />
