AN ORDINANCE <br />GRANTING A TELECOMMUNICATIONS FRANCHISE TO <br />NTELOS, INC., ITS SUCCESSORS AND ASSIGNS <br />TO USE THE STREETS AND OTHER PUBLIC PLACES <br />OF THE CITY OF CHARLOTTESVILLE, VIRGINIA <br />FOR ITS POLE, WIRES, CONDUITS, CABLES AND FIXTURES, <br />FOR A PERIOD OF FIVE (5) YEARS <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that <br />NTELOS, Inc. (the "Company"), its successors and assigns, is hereby granted a <br />telecommunications franchise for a period of five (5) years from the effective date hereof be and <br />is hereby authorized and empowered to erect, maintain and operate certain telephone lines and <br />associated equipment, including posts, poles, cables, wires and all other necessary overhead or <br />underground apparatus and associated equipment on, over, along, in, under and through the <br />streets, alleys, highways and other public places of the City of Charlottesville, Virginia (the <br />"City") as its business may from time to time require; provided that: <br />ARTICLE I <br />SECTION 101 PURPOSE AND SCOPE <br />• To provide for the health, safety and welfare of its citizens and to ensure the integrity of its roads <br />and streets and the appropriate use of the Public Rights -of -Way, the City strives to keep the <br />right-of-way under its jurisdiction in a state of good repair and free from unnecessary <br />encumbrances. <br />Accordingly, the City hereby enacts this Ordinance relating to a telecommunications right-of- <br />way franchise and administration. This Ordinance imposes regulation on the placement and <br />maintenance of Facilities and equipment owned by the Company currently within the City's <br />Public Rights -of -Way or to be placed therein at some future time. The Ordinance is intended to <br />complement, and not replace, the regulatory roles of both state and federal agencies. Under this <br />Ordinance, when excavating and obstructing the Public Rights -of -Way, the Company will bear <br />financial responsibility for their work to the extent provided herein. Finally, this Ordinance <br />provides for recovery of the City's reasonable out-of-pocket costs related to the Company's use <br />of the Public Rights -of -Way, subject to the terms and conditions herein. <br />SECTION 102 AUTHORITY TO MANAGE THE RIGHT OF WAY <br />This Ordinance granting a telecommunications franchise is created to manage and regulate the <br />Company's use of the City's Public Rights -of -Way along city roads pursuant to the authority <br />granted to the City under Sections 15.2-2015, 56-460, and 56-462(A) of the Virginia Code and <br />. other applicable state and federal statutory, administrative and common law. <br />Page 1 <br />
