• AN ORDINANCE AMENDING AND REENACTING <br />THE DISTRICT MAP INCORPORATED IN SECTION 34-15 <br />OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, BY THE RE -ZONING OF PROPERTY AT 214 STRIBLING AVENUE <br />(THE DYMOND PROPERTY) FROM "R -IA AND R-2" TO "R-2 PUD" <br />WHEREAS, Beyer/Huntley, LLC, Owner of Parcels 33 and 38 through 46 on City Tax Map 18A, <br />has submitted an application seeking a rezoning of its property from "R-lA Residential and R-2 Residential" <br />to "R-2 Planned Unit Development" (hereinafter, the "Proposed Rezoning"); and <br />WHEREAS, a joint public hearing on this application was held before the City Council and Planning <br />Commission on November 12, 2002, following notice to the public and to adjacent property owners as <br />required by law; and <br />WHEREAS, on November 12, 2002 the Planning Commission voted to recommend the Proposed <br />Rezoning; and <br />WHEREAS, this Council finds and determines, that the public necessity, convenience, general <br />welfare or good zoning practice requires the Proposed Rezoning; that both the existing "R-1 A and R-2" and <br />the proposed "R-2 PUD" zoning classifications are reasonable; and that the Proposed Rezoning is consistent <br />with the purpose and intent of the City Code, Chapter 34, Article XV; Now, therefore, <br />• BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the District Map <br />incorporated in Section 34-15 of the Zoning Ordinance of the Code of the City of Charlottesville, 1990, as <br />amended, be and hereby is amended and reenacted as follows: <br />Section 34-15. Zoning District Map. <br />Rezoning from R-lA Residential and R-2 Residential to R-2 Planned Unit Development Parcel 33 <br />and Parcels 38 through 46 on 2002 City Real Estate Tax Map 18A, containing approximately 22.8 acres of <br />land on Stribling Avenue, Sunset Road and Sunset Avenue. <br />Approved by Council <br />December 16, 2002 <br />C.� <br />C1 rk of City C uncil <br />
