. BE IF FURTHER ORDAINED that section 31-125 of the Code of the City of <br />Charlottesville is hereby amended and reordained to read as follows: <br />• <br />0 <br />Section 31-125. Conservation of Water during Emergencies. <br />(a) Should the City Gotmeil, at an), time, deelafe there to be an emefgeney in the City E) <br />emergeney to eFder the festriefion of prohibition of any or all of the following uses o'he <br />supply: Mandatory Restrictions: The following Phase I restrictions on the use of water drawn <br />from the City's public water supply are hereby prohibited: <br />(1) Watering of outside shrubbery, trees, lawns, grass, plants, home vegetable <br />gardens, or any other vegetation, except from a watering can or other container <br />not exceeding three (3) gallons in capacity. This limitation shall not apply to <br />commercial greenhouses or nursery stocks, which may be watered in the <br />minimum amount required to preserve plant life before 7:00 a.m. or after <br />8:00 p.m. <br />(2) Washing of automobiles, trucks, trailers, or any other type of mobile equipment, <br />except in licensed commercial vehicle wash facilities. <br />(3) Washing of sidewalks, streets, driveways, parking lots, service station aprons, <br />exteriors of homes or apartments, commercial or industrial buildings or any other <br />outdoor surface, except where mandated by federal, state or local law. <br />(4) The operation of any ornamental fountain or other structure making a similar use <br />of water. <br />(5) The filling or refilling of swimming or wading pools of any size. requiring -mere <br />than five (5) gallons of water-, or the refilling efswinuning of Wading pools whie <br />were drained after the etTeetive date of the deelaration of emefgeRey, exeept that <br />pools may be filled to a level of two (2) feet below normal, or water fia), be added <br />to bring the level to two (2) feet below nefml, of as neeessafy to proteet t <br />&efn,...a_,,stat:,, damage As used herein the phrase "filling or <br />refilling" shall mean the addition of any water to the pool from the public water <br />supply after the adoption of this amended ordinance. <br />(6) The use of water from fire hydrants for any purpose other than fire suppression, <br />unless otherwise approved by the City Manager. <br />(7) The serving of drinking water in restaurants, except upon request. <br />(8) The operation of any water-cooled comfort air conditioning that does not have <br />water conserving equipment in operation. <br />Phase H Restrictions: The following_ Phase II mandatory restrictions shall become effective at <br />such time as the Executive Director of the Rivanna Water and Sewer Authority certifies in <br />writing to the Director of Public Works of the City of Charlottesville that the usable water supply <br />in the urban reservoir system has declined to fifty-five percent (55%) or less of capacity (the <br />"effective date"): <br />
