AN ORDINANCE <br />• AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED <br />IN SECTION 34-15 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, BY THE RE -ZONING OF PARCEL 91.1, 2002 CITY TAX MAP 27, <br />FROM "B-2 BUSINESS and R-3 RESIDENTIAL" TO "PUD RESIDENTIAL" <br />WHEREAS, Burnet Land Trust, the Owner of Parcel 91.1 on 2002 City Tax Map 27, has <br />submitted an application seeking a rezoning of such property from `B-2 Business District" and <br />"R-3 Residential District" to "PUD Planned Unit Development Residential District" (hereinafter, <br />the "Proposed Rezoning"); and <br />WHEREAS, a joint public hearing on this application was held before the City Council <br />and Planning Commission on July 9, 2002, following notice to the public and to adjacent <br />property owners as required by law; and <br />WHEREAS, on July 9, 2002 the Planning Commission voted to recommend the <br />Proposed Rezoning; and <br />WHEREAS, this Council finds and determines that the public necessity, convenience, <br />general welfare or good zoning practice requires the Proposed Rezoning; that both the existing <br />`B-2 Business District and R-3 Residential District" and the proposed "PUD Residential <br />• District' zoning classifications are reasonable; and that the Proposed Rezoning is consistent with <br />the purpose and intent of the City Code, Chapter 34, Article X; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the <br />District Map Incorporated in Section 34-15 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-15. Zoning District Map. <br />Rezoning from B-2 Business District and R-3 Residential District to PUD Planned Unit <br />Development Residential District the property identified as Parcel 91.1 on 2002 City Tax <br />Map 27, having frontage on Burnet Street, and containing approximately 5.437 acres of land. <br />Approved by Council <br />September 3, 2002 <br />C <br />1 rk of City C uncil <br />0 <br />
