construction, all affected houses will receive written notification regarding <br />Grantee's construction schedule which will also include Grantee's <br />telephone number. Nothing shall prohibit Grantee from consolidating the <br />notices required in this paragraph. <br />7.02 Construction Delay. Grantee shall notify the City of any delay in the <br />construction. The City shall excuse only upon occurrence of unforeseen events <br />or acts of God, and may, in its discretion, excuse delay on any other occasion. <br />7.03 Verification of System Upgrade/Rebuild. Grantee shall provide City with <br />written notice that the System upgrade/rebuild has been completed in <br />accordance with all terms and provisions of this Franchise. The City shall have <br />ninety (90) days from the date of receipt of such written notice to receive a <br />written report from an independent engineer selected by City to verify completion <br />of construction in accordance with all terms and provisions of this Franchise and <br />all Applicable Laws. If the City fails to receive such written report within ninety <br />(90) days completion of the System upgrade/rebuild shall be deemed to have <br />taken place, unless the failure to receive such a report is due to unforeseen <br />events, acts of God, delays caused by Grantee, or events beyond the reasonable <br />control of the City. If City receives a written report within ninety (90) days of <br />completion of the System upgrade/rebuild from an independent engineer <br />establishing that the System upgrade/rebuild has been completed in accordance <br />with all terms. and provisions of this Franchise, the City shall bear the expense for <br />such independent engineer. If City receives a written report within ninety (90) <br />days of completion of the System upgrade/rebuild from an independent engineer <br />establishing that the System upgrade/rebuild has not been completed in <br />accordance with all material terms and provisions of this Franchise, Grantee shall <br />bear the expense for such independent engineer. <br />7.04 Construction Standards. <br />A. All construction practices shall be in accordance with all applicable <br />sections of the Occupational Safety and Health Act of 1970, as amended, <br />as well as all state and local codes where applicable. <br />B. All Installation of electronic equipment shall be of a permanent <br />nature, durable and installed in accordance with the provisions of the <br />National Electrical and Safety Code and National Electrical Code as <br />amended. <br />C. Antennas and their supporting structures (tower) shall be painted, <br />lighted, erected and maintained in accordance with all applicable rules and <br />regulations of the Federal Aviation Administration and all other applicable <br />state or local laws, codes and regulations. <br />18 <br />C] <br />• <br />
