"(C) reasonable attorneys' fees and other litigation costs <br />• reasonably incurred. <br />"(3) The remedy provided by this section shall be in addition to <br />any other lawful remedy available to a cable Subscriber. <br />"(g) Nothing in this title shall be construed to prohibit any State or <br />any franchising authority from enacting or enforcing laws consistent with <br />this section for the protection of Subscriber privacy. <br />"(h) A governmental entity may obtain personally identifiable <br />information concerning a cable Subscriber pursuant to a court order only <br />if, in the court proceeding relevant to such court order — <br />"(1) Such entity offers clear and convincing evidence that <br />the subject of the information is reasonably suspected of engaging <br />in criminal activity and that the information sought would be <br />material evidence in the case; and <br />"(2) the subject of the information is afforded the <br />opportunity to appear and contest such entity's claim. <br />SECTION 14. MISCELLANEOUS PROVISIONS <br />• 14.01 Compliance with Laws. Grantee and the City shall conform to all <br />Applicable Laws and rules regarding cable television as they become effective, <br />unless otherwise stated. Grantee shall also conform with all the generally <br />applicable City ordinances, resolutions, rules and regulations heretofore or <br />hereafter adopted or established during the entire term of the Franchise. <br />Grantee reserves its rights under Applicable Laws to challenge the validity of any <br />ordinance, resolution and regulation in a court of competent jurisdiction. <br />14.02 Franchise Renewal. This Franchise may be renewed in accordance with <br />Applicable Laws. <br />14.03 Continuity of Service Mandatory. Upon expiration or the termination of <br />this Franchise, the City may require Grantee to continue to operate the System <br />for an extended period of time not to exceed six (6) months. Grantee shall, as <br />trustee for its successor in interest, continue to operate the System under the <br />terms and conditions of this Franchise. In the event Grantee does not so operate <br />the System, the City may take such steps as it, in its sole discretion, deems <br />necessary to assure continued Service to Subscribers. <br />14.04 Work Performed by Other. <br />A. Grantee shall give notice to the City specifying the names and <br />addresses of any other entity, other than Grantee, which performs the <br />• following Services pursuant to this Franchise: <br />43 <br />
