• EXHIBIT A <br />CONSTRUCTION TERMS, SCHEDULE, AND SEQUENCE <br />CONSTRUCTION TERMS <br />A. Location of Cable <br />The Grantee shall install all underground cables and wires in a manner <br />consistent with good engineering practices and the facilities of the City. <br />B. Specific Terms <br />1. As provided in this Franchise, the Grantee shall comply with all applicable <br />federal, state, and City laws, rules, regulations, codes, including, but not limited <br />to, the provisions of the National Electrical Code (NEC) and National Electrical <br />Safety Code (NESC) and other requirements in connection with the construction <br />of the System. <br />2. The Installation of all cables, wires, or other component parts of the <br />System on City property shall be undertaken in a manner which does not <br />interfere with the operation of any existing MAN, SMATV, MDS, OBS, or other <br />distribution System on said property, including any conduit used in'connection <br />• with such other System. <br />3. The Grantee must comply with, and shall ensure that its subcontractors <br />comply with, all rules, regulations, and standards of the City and this Franchise. <br />If the Installation, construction, or operation of the System does not comply with <br />such rules, regulations, and standards, the Grantee must, at its sole cost, remove <br />and reinstall such cables, wires, or other component parts of the System to <br />ensure compliance with such rules, regulations, and standards. <br />• <br />4. In the course of implementing the system upgrade/rebuild, Grantee shall <br />be permitted to reuse cable that are already in place within the City limits, <br />provided that sweep frequency test results of each completed System segment <br />are demonstrated to not exceed a t 2.5 dB worst case headend to end -of -line <br />peak to valley criterion. All testing shall be conducted by Grantee with a copy of <br />the test results provided to the City at no cost to the City. <br />5. When complete, the upgraded/rebuilt System shall employ no greater than <br />seven (7) amplification devices (including the node) between any Subscribers' <br />connection point to the System and the point where Grantee receives its off -air, <br />microwave -relayed and/or satellite -based signals. Fiber optic trunk facilities <br />using no intermediate amplification or regeneration points shall be installed <br />between Grantee's headend/hub site serving the City and all of its satellite, off -air <br />broadcast and microwave reception facilities. <br />A-1 <br />
