• <br />(8)Ensure compliance with applicable provisions of the Fair Employment Contracting Act (§2.2- <br />4200 et seq. of the Code of Virginia) and of the Information Technology Access Act (§2.2-3500 et <br />seq. of the Code of Virginia) and other provisions of state law which may be applicable to specific <br />procurement transactions of the City. <br />(9)Perform such other functions and duties as may be assigned to him by the city manager. <br />(b)The purchasing manager may establish a written administrative procedure to govern the hearing of <br />protests of a decision to award, or an award; appeals from refusals to allow withdrawal of a bid; appeals <br />from disqualifications and determinations of non -responsibility; appeals from decisions on disputes <br />arising during the performance of a contract; or any of these. Such administrative procedure shall be <br />consistent with the requirements of §2.24365 of the Code of Virginia, and shall be approved by the city <br />manager and the city attorney. <br />"Sec. 22-32. Unauthorized purchases. <br />Except as otherwise provided in this chapter, no city official, elected or appointed, an no city <br />employee, shall purchase or contract for any goods, services, insurance or construction within the <br />purview of this chapter other than by and through the purchasing manager. Any purchase order or <br />other contract made contrary to the provisions of this section is not approved and the city shall not be <br />bound thereby. Any city official or employee who violates the provisions of this section shall be held <br />personally liable for such purchase, and, if already paid for out of city funds, the amount may be <br />recovered in the name of the city in an appropriate action instituted therefor. <br />17 Compare current §22-23. <br />Page 11 of 11 <br />Approved by Council <br />November 15, 2004 <br />k of City Council <br />• <br />
