5. Article II, Division 2, Sections 5-57 through 5-64 are hereby deleted, in their entireties. <br />6. Article II, Division 2, is hereby amended to enact a new Section 5-57, as follows: <br />Sec. 5-57. Tradesmen. <br />(a) In the event the building official finds that an individual is practicing as a tradesman, liquefied <br />petroleum gas fitter or natural gas fitter provider (as those terms are defined within &54.1-1 128 of the <br />Virginia Code) without a license as required by state law, the building official shall file a report to <br />that effect with the state Board for Contractors. <br />• (b) If the building official has reason to believe that (i) a tradesman, liquefied petroleum gas fitter, or <br />natural gas fitter provider is performingincompetently ncompetently as demonstrated by an egregious or repeated <br />violation of the USBC, or (ii) a certified backflow prevention device worker is performing <br />incompetently, as demonstrated by an egregious or repeated violation of the standards adopted by the <br />American Society of Sanitary Engineering referenced in the plumbing code adopted by the USBC, <br />then the building official shall file a report to such effect with the state Board for Contractors. <br />7. Article III, Sections 5-86 through 5-97 are hereby deleted, in their entireties. <br />Approved by Council <br />November 1, 2004 <br />C e k of City Council <br />
