Adopted by City Council on September 20, 2004 <br />so/ AN ORDINANCE TO RE-ENACT CHAPTER 10 (EROSION <br />AND SEDIMENT CONTROL) OF THE CHARLOTTESVILLE CITY CODE AS THE <br />CITY WATER PROTECTION ORDINANCE. <br />BE IT ORDAINED that: <br />1. Chapter 10 of the Code of the City of Charlottesville (1990), as amended, as it exists on the <br />date of this enactment, is hereby repealed in its entirety, and said Chapter is re-enacted as <br />follows: <br />ARTICLE I. IN GENERAL <br />Sec. 10-1. Short title. <br />This chapter shall be known and may be cited as the City's "Water Protection Ordinance." <br />Sec. 10-2. Authority. <br />This chapter is adopted pursuant to authority conferred by the Virginia Erosion and Sediment <br />Control Law (Virginia Code §§ 10.1-560 et seq.), the Virginia Stormwater Management Act <br />(Virginia Code §§ 10.1-603.1 et seq.), Virginia Code § 10.1-2108 of the Chesapeake Bay <br />Preservation Act, and the federal Clean Water Act. <br />• Sec. 10-3. Purposes. <br />The city council finds that this chapter is necessary to protect the health, safety and general <br />welfare of the citizens of the City and the Commonwealth of Virginia and to prevent water from <br />being rendered dangerous to the health of persons living in the city, and is supported by the <br />findings of related studies that have been conducted. Therefore, the specific purposes of this <br />chapter are to: <br />(1) Inhibit the deterioration of public waters and waterways resulting from land disturbing <br />activities; <br />(2) Protect the safety and welfare of citizens, property owners, and businesses by minimizing the <br />negative impacts of increased stormwater runoff from new land development and redevelopment; <br />(3) Control nonpoint source pollution, erosion and sedimentation, and stream channel erosion; <br />(4) Maintain the integrity of existing stream channels and networks for their biological functions, <br />drainage, and natural recharge of groundwater; <br />(5) Protect the condition of public waters for all reasonable public uses and ecological functions; <br />(6) Provide for the long-term responsibility for and maintenance of stormwater management <br />facilities and best management practices; <br />(7) Facilitate the integration of stormwater management and pollution control with other city <br />• <br />ordinances and with federal, state and local programs, policies, regulations and guidelines; and <br />-1- <br />
