constructed in accordance with this chapter, based on specific terms and conditions of the <br />• agreement. <br />Stormwater management plan means a document containing material that describes how existing <br />runoff characteristics will be maintained within a land development project, that describes <br />controls for the management of the rate of Stormwater discharge, and that describes any best <br />management practices provided for water quality protection. A stormwater management plan may <br />include a narrative section, a map or site plan, pertinent calculations and specifications included <br />with the plan. <br />Stream buffer means an area of land at or near a tributary streambank and/or nontidal wetland that <br />has an intrinsic water quality value due to the ecological and biological processes it performs or is <br />otherwise sensitive to changes which may result in significant degradation to the quality of state <br />waters. <br />Subdivision means the division, including resubdivision, of any lot, tract or parcel of land into <br />two (2) or more lots, tracts or parcels, for the purpose, whether immediate or future, of sale or <br />building development. <br />Water dependent facility refers to land development that cannot exist outside the stream buffer <br />and must be located on a shoreline because of the intrinsic nature of its operation, including, <br />without limitation: intake and outfall structures of water and sewage treatment plants and storm <br />sewers; water -oriented recreation areas; and boat docks and ramps. <br />Watershed means a defined land area drained by a river, stream or drainage ways, or system of <br />• connecting rivers, streams, or drainage ways such that all surface water within <br />the area flows through a single outlet. <br />Wetlands, non -tidal means wetlands other than tidal wetlands that are inundated or saturated by <br />surface or groundwater at a frequency and duration to support, and that under normal <br />circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil <br />conditions, as defined by the U.S. Environmental Protection Agency pursuant to section 404 of <br />the federal Clean Water Act. <br />Sec. 10-6 Designation of program authority; powers and duties. <br />(a) The city council hereby designates the department of neighborhood development services as <br />the program authority for articles II, III, and IV. <br />(b) The program authority shall administer and enforce the provisions of this chapter, acting by <br />and through authorized city officials and employees. <br />(c) The program authority shall establish reasonable regulations and interpretive guidelines for <br />the administration of this chapter. Such regulations and guidelines shall be consistent with this <br />chapter and all applicable federal and state statutes and regulations (including, without limitation, <br />the provisions of Va. Code § 10.1-570 and § 10.1-603.7, and they shall be subject to the approval <br />of city council. <br />(d) Within one year of the date of adoption of this chapter the program authority shal I assure that <br />the erosion and sediment control program set forth in article II is administered by a certified <br />• <br />
