AN ORDINANCE • AMENDING AND REORDAINING CHAPTER 34 (ZONING), ARTICLE I, SECTION 34-1, AND ARTICLE II, SECTION 34-272, OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, TO ADD A SEVENTH ZONING OVERLAY DISTRICT TO BE DESIGNATED AS THE OAKHURST-GILDERSLEE VE ARCHITECTURAL DESIGN CONTROL DISTRICT. WHEREAS, pursuant to §34-288 of the City code, the Board of Architectural Review ("BAR") has conducted a survey to study the merits of a prospective major design control district, to be referred to as the Oakhurst -Gildersleeve Neighborhood Architectural Design Control District ("Oakhurst -Gildersleeve ADC") and has recommended that such a district be established and that certain properties should be included therein; WHEREAS a joint public hearing on the BAR's proposal (ZT-04-10-20 and ZM 04-10-21, together) was held before the City Council and Planning Commission on November 9, 2004, following notice to the public and property owners as required by law; and WHEREAS, at the public hearing the University of Virginia requested that six (6) properties located at the terminus of Valley Road (Parcels 31, 32, 34, 80, 82 and 83 • on City Real Estate Tax Map 11) be excluded from the Oakhurst -Gildersleeve ADC, and Neighborhood Development Services staff and neighborhood representatives have no objection; and WHEREAS, on November 9, 2004 the Planning Commission voted to recommend to City Council that the proposed Oakhurst -Gildersleeve ADC as advertised for the public hearing, should be established, and that certain properties should be included therein; and WHEREAS, this City Council has considered the recommendations of the Planning Commission, the BAR, and staff, and WHEREAS, this City council finds and determines that the proposed amendments to the City's zoning ordinance (ZT-04-10-20 and ZM 04-10-21, respectively) would serve the purposes set forth within §34-271 of the City Code and that the public necessity, convenience, general welfare or good zoning practice requires enactment of the City's zoning ordinance and the zoning map referenced therein; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that: 1.
