Prepared November 15, 2005 <br />• AN ORDINANCE <br />AMENDING AND REORDAINING CHAPTER 10 AND CHAPTER 31 <br />OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />RELATING TO WATER PROTECTION AND EROSION ISSUES <br />BE IT ORDAINED by the Council for the City of Charlottesville, Virginia, that <br />Sections 10-5, 10-6, 10-31, 10-50, 10-51, 10-54, 10-76, 10-91, 10-92, and 10-93 of Chapter 10, <br />and Sections 31-186 and 31-191 of Chapter 31, of the Charlottesville City Code, 1990, as <br />amended, are hereby amended and reordained, as follows: <br />CHAPTER 10. EROSION AND SEDIMENT CONTROL WATER PROTECTION <br />ARTICLE 1. IN GENERAL. <br />Sec. 10-5. Definitions. <br />Public waters means and refers to thewateFs FefeFs te the public waters and waterways of the <br />United States and of the Commonwealth of Virginia. <br />Sec. 10-6. Designation of program authority; powers and duties. <br />(a)The city council hereby designates the department of neighborhood development services as <br />• the program authority for Articles 11, Ill, and 1V. Administration and enforcement of Article V <br />shall be as set forth within H 10-92 and 10-93. <br />• <br />ARTICLE II. EROSION AND SEDIMENT CONTROL <br />10-31. Applicability. <br />This article shall apply to any land disturbing activity. Each owner shall comply with the <br />requirements of this article, as provided herein: <br />(1).... <br />(2).... <br />(3)When notified by the program authority that an erosion impact area exists on his land, and the <br />notice requires the owner to submit an erosion and sediment control plan in order to control <br />erosion and sedimentation;—and-. <br />ARTICLE III.
