• AN ORDINANCE <br />AMENDING AND REENACTING THE ZONING DISTRICT MAP INCORPORATED <br />IN SECTION 34-1 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />(AS AMENDED) BY THE RE -ZONING OF <br />PARCEL 374, CITY TAX MAP 59 <br />FROM "R -1S" TO "PUD" <br />(701-707 PALATINE AVENUE) <br />WHEREAS, MGR Development Corporation, by its representative Massimo G. Rampini, is the <br />contract purchaser of Parcels 374, City Tax Map 59 ("Subject Property") and has made application seeking a <br />rezoning of the Subject Property from "R -IS" to "PUD," ("Proposed Rezoning"), subject to a PUD <br />Development Plan dated June 24, 2004 ("PUD Development Plan"), all part of ZM-04-07-14; and <br />WHEREAS, ajoint public hearing on the Proposed Rezoning was held before the City Council and <br />Planning Commission on October 12, 2004, following notice to the public and to adjacent property owners as <br />required by law; and <br />WHEREAS, on October 12, 2004 the Planning Commission voted to recommend the Proposed <br />Rezoning, subject to the voluntary development conditions ("proffers") set forth within a Preliminary Proffer <br />Statement dated September 30, 2004; and <br />WHEREAS, the applicant has submitted a Final Proffer Statement, dated October 18, 2004, for <br />• Council's review and consideration, which contains final proffers consistent with those reviewed and <br />recommended by the Planning Commission; and <br />WHEREAS, this Council finds and determines that: <br />(])The Proposed Rezoning is consistent with the Comprehensive Plan, and with the purpose and intent <br />of the Planned Unit Development District, as articulated within the City Code, Chapter 34, Article V; and <br />(2) The existing zoning and the proposed zoning district classification are both reasonable; and <br />(3)The public necessity, convenience, general welfare, or good zoning practice requires the Proposed <br />Rezoning; <br />Now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the <br />Zoning District Map Incorporated in Section 34-1 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-1. Zoning District Map. Rezoning from "R -IS" Residential to Planned Unit Development (PUD) <br />district all of the property, consisting of approximately 178,824 square feet (4.1 acres) currently identified on <br />City Tax Map 59 as Parcel 374, subject to the following: all development must conform to the density, height <br />and other dimensional requirements, the general location of streets and other public improvements, the nature <br />and general location of uses, and the setbacks and other development conditions identified and depicted within <br />the PUD Development Plan and to the voluntary conditions set forth within the Final Proffer Statement dated <br />October 18, 2004. <br />Approved by Council <br />• January 3, 2005 1 rk of City Co ncil <br />
