AN ORDINANCE AMENDING AND REENACTING THE ZONING DISTRICT <br />• MAP INCORPORATED IN SECTION 34-1 OF THE ZONING ORDINANCE OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1990, (AS AMENDED) <br />BY THE RE -ZONING OF PARCEL 88.8, CITY TAX MAP 55A (1901 CHESAPEAKE <br />STREET) AND OF A PORTION OF PARCEL 151, CITY TAX MAP 55A (A PORTION <br />OF RIVERVIEW PARK) FROM "R-2" and 1`R-1 S" TO "PUD" <br />WHEREAS, Rivanna Collaborative, LLC ("Applicant') has made application for a rezoning of <br />Parcel 88.8, City Tax Map 55A, consisting of approximately 0.5320 acre and of a portion of Parcel 151, <br />Tax Map 55A, consisting of approximately 0.25 acres (together, "Subject Property") from "R-2" and "R- <br />TS" residential, respectively, to "PUD" ("Proposed Rezoning"), subject to a PUD Development Plan <br />dated March 22, 2005, and the narrative materials and sketches attached thereto (together, "PUD <br />Development Plan") submitted by the Applicant as part of ZM-05-04-7; and <br />WHEREAS, a public hearing on the Proposed Rezoning was held before the Planning <br />Commission on June 14, 2005, following notice to the public and to adjacent property owners as required <br />by law; and <br />WHEREAS, a public hearing on the Proposed Rezoning was held before the City Council on <br />July 5, 2005, following notice to the public and to adjacent property owners as required by law; and <br />WHEREAS, on June 14, 2005 the Planning Commission voted to recommend the Proposed <br />Rezoning; and <br />WHEREAS, this Council finds and determines that: <br />• (])The Proposed Rezoning is consistent with the Comprehensive Plan, and with the purpose and <br />intent of the Planned Unit Development District, as articulated within the City Code, Chapter 34, Article <br />V; and <br />(2)The existing zoning and the proposed zoning district classification are both reasonable; and <br />(3)The public necessity, convenience, general welfare, or good zoning practice requires the <br />Proposed Rezoning. <br />Now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that <br />the Zoning District Map Incorporated in Section 34-1 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-l. Zoning District Map. Rezoning from "R-2" and "R -IS" residential to Planned Unit <br />Development (PUD) district all of the property located at 1901 Chesapeake Street, consisting of <br />approximately 0.5320 acre (approximately 23,174 square feet) identified on City Tax Map 55A as Parcel <br />88.8, and a portion of Riverview Park, consisting of approximately 0.25 acre (approximately 10,890 <br />square feet) currently identified on City Tax Map 55A as Parcel 151, subject to the following: all <br />development must conform to the density, height and other dimensional requirements, the general <br />location of streets and other public improvements, the nature and general location of uses, and the <br />setbacks and other development conditions identified and depicted within the PUD Development Plan. <br />Approved by Council AA 4 <br />cic <br />• July 18, 2005 C r of City Council <br />
