ordinances, regulations and rules, now in effect or adopted by the City during the term of this Lease, <br />governing the use and occupancy of the Downtown Mall and the operation of the newsstand, <br />including but not limited to the requirement to obtain a certificate of appropriateness prior to <br />• installation of the newsstand pursuant to City Code §§ 34-271 et seq. <br />(9) MAINTENANCE: The Tenant shall maintain the newsstand and the Leased Premises in a <br />neat and clean condition at all times. Trash and refuse shall be promptly removed from the kiosk and <br />disposed of in a lawful manner. Unsold newspapers and magazines shall not be discarded in <br />Downtown Mall trash receptacles. <br />(10) INSURANCE AND INDEMNIFICATION: The Tenant shall at all times during the term of <br />this Lease keep in full force and effect a policy of public liability and property damage insurance with <br />respect to the newsstand and any business conducted thereon, with a combined single limit of liability <br />of not less than $1,000,000 (combined single limit) for public liability and property damage. Such <br />policy shall be endorsed to name the City of Charlottesville as an additional insured, and shall not be <br />canceled without fifteen (15) days prior notice to the City. This Lease shall not become effective <br />unless and until a certificate evidencing such insurance is submitted to and approved by the City. <br />The Tenant hereby agrees to indemnify and hold harmless the City and its officers and <br />employees against any expense, loss, costs and damages, including attorney's fees, arising out of <br />any breach or default by the Tenant of any provision of this Lease, or that are the result of the <br />Tenant's use or occupancy of the Leased Premises. <br />(11) LEASE TERMINATION: The City and the Tenant shall each have the right to terminate <br />this Lease upon sixty (60) days prior written notice to the other party. The City shall have the <br />additional right to immediately terminate this Lease if the Tenant breaches any provision of this Lease <br />• and fails to cure such breach within thirty (30) days after written notice is sent to the Tenant by the <br />City. <br />(12) SURRENDER OF PREMISES: At the end of the term of this Lease or upon its termination <br />the Tenant shall, within ten (10) calendar days remove the newsstand and any related equipment or <br />fixtures from the Mall. Tenant shall be responsible for any damage resulting from the removal. <br />Should Tenant fail to remove the newsstand, equipment and fixtures as required by this Paragraph, <br />the City shall have the right to perform the removal and to dispose of the property at its discretion, <br />with Tenant being responsible for the cost of the removal and disposal. <br />(13) NOTICES: Any notice given under this Lease shall be in writing and delivered in person or <br />by first class mail, postage prepaid to the following, or to such other address as the City or the Tenant <br />may designate in writing: <br />For the City: For the Tenant: <br />Director of Neighborhood Development Services Steven Russell <br />City Hall 115-B Megan Court <br />P.O.
