AN ORDINANCE <br />AMENDING AND REENACTING ARTICLES I, II AND III OF <br />• CHAPTER 4 ("ANIMALS AND FOWL") OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />BY REVISING EXISTING DEFINITIONS RELATED TO THE REGULATION <br />OF ANIMALS, INCLUDING THE DEFINITION OF RUNNING AT LARGE AND <br />EXISTING PROVISONS PRESCRIBING CRUELTY TO ANIMALS; BY <br />ADDING NEW SECTIONS RELATED TO THE DISPOSITION OF DEAD <br />ANIMALS, TO THE TETHERING OF DOGS, TO THE CONFINEMENT OF <br />ANIMALS IN VEHICLES AND TO THE REGULATION OF DOGS <br />DETERMINED TO BE DANGEROUS OR VICIOUS; AND <br />REVISING THE AMOUNT OF THE DOG LICENSE TAX <br />BE IT ORDAINED BY THE council for the City of Charlottesville, Virginia <br />that Articles I, II and III are hereby amended and reenacted as set forth below, including <br />the addition of new sections 4-4, 4-11, 4-15 through 4-22, and 4-43 through 4-47: <br />ARTICLE I. IN GENERAL <br />Sec. 4-1. Violations of chapter. <br />Unless otherwise specifically provided, a violation of any provision of this <br />chapter shall constitute a Class 1 misdemeanor. <br />Sec. 4-2. Definitions. <br />The following words, terms and phrases, when used in this chapter, shall have the <br />meanings ascribed to them in this section, except where the context clearly indicates a <br />different meaning: <br />Abandon means to desert, forsake, or absolutely give up an animal without having <br />secured another owner or custodian for the animal or by failing to provide the elements of <br />basic care as set forth in section Virginia Code sec. 3.1-796.68 for a period of five (5) <br />consecutive days. <br />Agricultural animals means all livestock and poultry. <br />Animal means any nonhuman vertebrate species except fish. For the pumoses of section <br />4-15, "animal' means any nonhuman vertebrate species including fish except those fish <br />captured and killed or disposed of in a reasonable and customary manner. <br />Animal warden control officer means any person s,^^^• ^^ Sush R ffieer by the ehie f of <br />peliee.* appointed as an animal control officer or deputy animal control officer as <br />• provided in Virginia Code § 3.1-796.66. <br />
