Leash means a physical restraint made of leather, chain, rope, or other reasonably strong • material, which is securely attached to a dog's collar or harness and which is intended to be held by an owner of a dog or attached to an immovable object. Owner means every person 7,,...:..g right of pfopeFty of eustedy in .,., ,.nirn.,i or who keeps „_ harbors an -..imam or has it in his eaFe any person who: (i) has a right of property in an animal; (ii) keeps or harbors an animal; (iii) has an animal in his care; or (iv) acts as a custodian of an animal. Pound means a facility operated by the City, or under a contract with any county, city, town, or incorporated society for the prevention of cruelty to animals, for the purpose of impounding or harboring seized, stray, homeless, abandoned or unwanted animals under a contract with the City. Primary enclosure means any structure used to immediately restrict an animal or animals to a limited amount of space, such as a room, pen, cage, compartment, or hutch. For tethered animals, the term includes the shelter and the area within reach of the tether. Sore shall have the same meaning as set forth in Virginia Code § 3.1-796.66. Sterilized means a surgical or chemical procedure performed by a licensed veterinarian that renders a dog or cat permanently incapable of reproducing. • To run at large or running at large means to roam, loiter, walk, run or be on or off the premises of the owner without being fenced, caged, physically carried, kept in an enclosure or held by leash by a person thoroughly capable both physically and mentally of controlling the animal. ,or within the inimediate veiee entrol of the owner. A dog shall not be considered to be running at large if it is both (i) sterilized, as defined in this Chapter; and (ii) within the immediate voice control of its owner; provided, however, that the immediate voice control option shall not be applicable in those areas where a leash is mandatory pursuant to section 4-40. Treatment or adequate treatment means the responsible handling or transportation of animals in the person's ownership, custody or charge, appropriate for the age, species, condition, size and type of the animal. [NOTE: These additional definitions are adopted from Virginia Code § 3.1-796.66. The revision to the "running at large" definition, which limits the "voice control" option, is in recognition of the fact that a large percentage of dog attacks and bites are committed by dogs that have not been spayed or neutered].
