Leash means a physical restraint made of leather, chain, rope, or other reasonably strong <br />• material, which is securely attached to a dog's collar or harness and which is intended to <br />be held by an owner of a dog or attached to an immovable object. <br />Owner means every person 7,,...:..g right of pfopeFty of eustedy in .,., ,.nirn.,i or who keeps <br />„_ harbors an -..imam or has it in his eaFe any person who: (i) has a right of property in an <br />animal; (ii) keeps or harbors an animal; (iii) has an animal in his care; or (iv) acts as a <br />custodian of an animal. <br />Pound means a facility operated by the City, or under a contract with any county, city, <br />town, or incorporated society for the prevention of cruelty to animals, for the purpose of <br />impounding or harboring seized, stray, homeless, abandoned or unwanted animals under <br />a contract with the City. <br />Primary enclosure means any structure used to immediately restrict an animal or animals <br />to a limited amount of space, such as a room, pen, cage, compartment, or hutch. For <br />tethered animals, the term includes the shelter and the area within reach of the tether. <br />Sore shall have the same meaning as set forth in Virginia Code § 3.1-796.66. <br />Sterilized means a surgical or chemical procedure performed by a licensed veterinarian <br />that renders a dog or cat permanently incapable of reproducing. <br />• To run at large or running at large means to roam, loiter, walk, run or be on or off the <br />premises of the owner without being fenced, caged, physically carried, kept in an <br />enclosure or held by leash by a person thoroughly capable both physically and mentally <br />of controlling the animal. ,or within the inimediate veiee entrol of the owner. A dog <br />shall not be considered to be running at large if it is both (i) sterilized, as defined in this <br />Chapter; and (ii) within the immediate voice control of its owner; provided, however, that <br />the immediate voice control option shall not be applicable in those areas where a leash is <br />mandatory pursuant to section 4-40. <br />Treatment or adequate treatment means the responsible handling or transportation of <br />animals in the person's ownership, custody or charge, appropriate for the age, species, <br />condition, size and type of the animal. <br />[NOTE: These additional definitions are adopted from Virginia Code § 3.1-796.66. <br />The revision to the "running at large" definition, which limits the "voice control" <br />option, is in recognition of the fact that a large percentage of dog attacks and bites are <br />committed by dogs that have not been spayed or neutered]. <br />Sec. 4-3. City pound designated; holding period for impounded animals. <br />The Charlottesville -Albemarle S.P.C.A. shelter, pursuant to a contract between <br />the SPCA and the City of Charlottesville, shall serves as the city pound for the purposes <br />• <br />3 <br />
