In addition to the penalties provided in subsection (a). the court mav, in its <br />• discretion, require any person convicted of a violation of subsection (a) to attend an anger <br />management or other appropriate treatment program or obtain psychiatric or <br />psychological counseling. Any person convicted of violating this section may be <br />prohibited by the court from possession or ownership of companion animals. <br />[NOTE: This section updates the current City Code section on animal cruelty to match <br />the corresponding section of state law]. <br />Sec. 4-16. City designated bird sanctuary; protection of birds and wild fowl. <br />(a) The entire area embraced within the corporate limits of the city is hereby <br />designated as a bird sanctuary. <br />(b) It shall be unlawful for any person to trap, hunt or shoot any bird or wild fowl, <br />or attempt to do the same, or to tamper with or rob nests of any bird or wild fowl. It shall <br />likewise be unlawful for any person to kill any sparrow, martin, wren or other bird. <br />(c) This section shall not apply to pigeons or starlings. <br />Sec. 4-17. Abandonment of animal; penalty. <br />• No person shall abandon or dump any animal. Violation of this section is a Class <br />3 misdemeanor. Nothing in this section shall be construed to prohibit the release of an <br />animal by its owner to a pound, animal shelter, or other releasing agency. <br />Sec. 4-18. Use of animal leg -hold traps. <br />The use by any person of an animal trap designed to catch an animal by closing <br />on a limb, whether made of steel or other material, is prohibited within the city. Any <br />person setting such a trap anywhere in the city, whether or not any animal was caught in <br />the trap, shall be guilty of a violation of this section. <br />Sec. 4-19. Confinement of animals in vehicles prohibited. <br />(a) It shall be unlawful for any person to place or confine an animal or allow an <br />animal to be placed or confined in a motor vehicle under such conditions or for such a <br />period of time as to endanger the health or well-being of such animal due to temperature, <br />lack of food or drink, or such other conditions as may reasonably be expected to cause <br />suffering, disability, or death. After making a reasonable effort to find the driver of a <br />vehicle in which an animal is confined, the animal control officer or other law <br />enforcement officer may use the least intrusive means to enter the vehicle if necessary to <br />11 <br />
