AN ORDINANCE <br />• AMENDING AND REORDAINING SECTION 4-42 <br />OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />RELATED TO THE TETHERING OF DOGS. <br />F -I <br />L <br />0 <br />BE IT ORDAINED by the Council for the City of Charlottesville, Virginia, that <br />Section 4-42 of Article III of Chapter 4 (Animals and Fowl) of the Code of the City of <br />Charlottesville, 1990, as amended, is hereby amended and reordained, as follows: <br />Section 4-42. Limitation on tethering, tying or chaining dogs. <br />(a) It shall be unlawful for any owner to tie, chain or tether a dog to any fixed or <br />stationary object, or any other object designed to confine and limit the movement of the <br />dog, for a period in excess of ten (10) eonseetitive cumulative hours during any 24 hour <br />period. <br />(b) Any person who violates this section shall be guilty of a Class 4 misdemeanor; <br />provided that, upon a third conviction within one (1) year of any offense under this <br />section, whether or not involving the same dog, the defendant shall be deemed guilty of a <br />Class 3 misdemeanor. <br />Approved by Council <br />March 5, 2007 <br />le c of City Council <br />
