AN ORDINANCE AUTHORIZING THE LEASING OF APPROXIMATELY 3 — 5 ACRES OF PROPERTY WITHIN MCINTIRE PARK FOR THE CONSTRUCTION OF A COMMUNITY FITNESS AND RECREATION CENTER WHEREAS, the City of Charlottesville seeks to lease property in McIntire Park located within the City of Charlottesville for the purpose of allowing construction and operation of a community fitness and recreation center; and WHEREAS, Council for the City of Charlottesville finds that such lease is in the best interest of the City, as the construction and operation of a community fitness and recreation center by Piedmont Family YMCA, Inc. shall provide the Charlottesville community and general public with new aquatics facilities; youth, adult and senior recreational opportunities; health and wellness activities; and therapeutic recreational programs, as well as enhanced cultural and enrichment opportunities; and WHEREAS, in accordance with Virginia Code Sections 15.2-2100, et seq., this ordinance was duly advertised for the purpose of receiving bids; and WHEREAS, in accordance with Virginia Code Section 15.2-2102, a bid has been selected; and WHEREAS, in accordance with Virginia Code Section 15.2-1800(B), a public • hearing was held on October 15, 2007 to give the public the opportunity to comment on the proposed lease of the above City -owned land to a third party; now therefore; NOW, THEREFORE, BE IT ORDAINED by the Council for the City of Charlottesville, Virginia that the City Manager is hereby authorized to execute a lease agreement, in substantially the same form as attached hereto, for the leasing of property within McIntire Park as described in the attached lease agreement.
