AN ORDINANCE <br />• CLOSING, VACATING, AND DISCONTINUING <br />A PORTION OF VALLEY ROAD <br />WHEREAS, the Rector and Visitors of the University of Virginia, owner of <br />properties designated as Parcels 28, 31, 32, 34, and 35 on City Tax Map 11, and the <br />University of Virginia Foundation, owner of properties designated as Parcels 82, 83, <br />83.1, 91, 92. 1, and 92.2 on City Tax Map 11, have initiated a petition seeking to close a <br />portion of the Valley Road right of way located adjacent to their properties; and <br />WHEREAS, the Street which is the subject of this petition was created, circa <br />1924, by a subdivision plat recorded in the Charlottesville land records at Deed Book 49, <br />page 310; and <br />WHEREAS, after consideration of the factors set forth within the City's Street <br />Closing Policy, adopted by Council on February 7, 2005, and in accordance with Va. <br />Code §15.2-2272, this Council finds and determines that the petitioners' request should <br />be granted; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that a <br />portion of the Valley Road right of way is hereby closed, vacated and discontinued, being <br />more particularly described as follows: <br />• That portion of the Valley Road right of way, shown and labeled as Tracts <br />A through I on the attached plat dated March 2, 2007, last revised May 24, <br />2007, made by Kirk Hughes & Associates, running approximately 356 feet <br />westward from Brandon Avenue, and thence approximately 130 feet in a <br />southerly direction, and located adjacent to Parcels 28, 31, 32, 34, 35, 82, <br />83, 83.1, 91, 92. 1, and 92.2, as shown on the 2007 City Tax Map 11. <br />PROVIDED, HOWEVER: <br />1. That the City of Charlottesville hereby reserves unto itself a perpetual <br />easement encompassing the entire vacated area, including the perpetual right <br />of ingress and egress over the vacated area for the purpose of installing, <br />maintaining, repairing or replacing water, sanitary sewer, stormwater or <br />natural gas lines which may be installed within the vacated area. <br />2. That the University of Virginia construct and maintain a sidewalk connecting <br />Brandon Avenue to the new cul-de-sac terminus of Valley Road, and that a <br />public access easement be created for said sidewalk area and recorded in the <br />Circuit Court Clerk's Office. <br />3. Parking of vehicles, except emergency vehicles, shall be prohibited on the cul- <br />de-sac terminus of Valley Road, at the discretion of the City Traffic Engineer. <br />
