• A RESOLUTION REQUESTING THE BOARD OF SUPERVISORS <br />OF ALBEMARLE COUNTY TO INITIATE A "DOWN" ZONING <br />OF PROPERTIES ADJACENT TO THE SOUTH RIVANNA RESERVOIR. <br />WHEREAS, this Council has previously expressed to the Board of Supervisors of <br />Albemarle County its support for the adoption of land use control measures to protect <br />the South Rivanna Reservoir and other community water supply sources; and <br />WHEREAS, it has become increasingly apparent that the protection of the South <br />Rivanna Reservoir requires the rezoning of immediately adjacent lands from their <br />present classifications to the CVN-Conservation District classification under the <br />Albemarle County Zoning Ordinance, and <br />WHEREAS, it is the sense of this Council that such a "down" zoning would be a <br />valid and lawful exercise of the County's police powers, necessary and proper to <br />protect an essential public resource; now, therefore, be it <br />RESOLVED, by the Council of the City of Charlottesville that the Board of <br />Supervisors of Albemarle County be requested immediately to initiate action to rezone <br />all properties adjacent to the South Rivanna Reservoir, up to and including the first <br />natural ridge line, from their present classifications to the CVN-Conservation District <br />classification; and be it further <br />• RESOLVED, that the Council hereby expresses its intention to authorize the <br />City staff to provide assistance to the County of Albemarle, and its willingness for <br />the City to participate, in any litigation necessary to establish the validity of such <br />rezoning action. <br />Adopted by the Council <br />October 27, 1977 <br />Copy Teste: <br />Clerk <br />CJ <br />
