City of Charlottesville ,Virginia <br />Office of Clem. of the Council <br />AN EXTRACT FROM THE MINUTES OF THE MEETING OF THE COUTICIL HELD <br />ON MONDAY, JULY 17, 1978 <br />• On motion by t'4r. Gatewood, seconded by Mr. Buck, the following resolution <br />and prefatory statement was adopted by the -following recorded vote. Ayes: <br />Mr. Brunton, Mr. Buck, Mr. Gatewood and Mrs. O'Brien. Noes: None. Abstained: <br />.. Mr. Albro. <br />WHEREAS, at a meeting of the City Council on June. 19, 1978, Council <br />adopted a resolution opposing certain petitions filed with the Federal <br />Communications Commission by the Amaturo Group, Inc., and others, in Becket <br />He. 19995 RM 2275, concerning, Network Program Exclusivity Protection by <br />Cable Television Systems, stating in such resolution that it was the opinion <br />of Council that the public interest of the citizens of Charlottesville was <br />better served by Regulation SS76.92(g) as it now exists; and <br />WHEREAS, it has subsequently come to the attention of Council that <br />there are a variety of considerations with respect to network program <br />exclusivity of which Council was not apprised; and <br />WHEREAS, it appears that in order to make an intelligent decision <br />• concerning network program exclusivity protection, it would be necessary for <br />Council to as <br />a variety of technical and economic data and determine <br />a method of applying such material in the context of FCC regulations; and <br />WHEREAS, such data is not readily available to Council or the city <br />administration and the entire matter would appear to be more appropriately <br />resolved by the FCC, which has special expertise; <br />NOW,,THEREFORE, the resolution of Council dated June 19, 1978, <br />touching upon the matters referred to above, be, and it hereby is, rescinded. <br />and annulled, and Council expresses no opinion upon the advisability of network <br />program exclusivity protection by cable television systems and whether such <br />exclusivity may or may not be in the public interest of the citizens of <br />Charlottesville, Virginia. <br />
