A RESOLUTION GRANTING A SPECIAL PERMIT FOR THE USE OF PROPERTY LOCATED ON 15th STREET, N. W. AS A NURSING HOME. WHEREAS, Mrs. Mary Scott Blake has applied for a special permit to use property located on 15th Street, N. W. designated as Parcel 16 on City Real Property Tax Map 9 as a nursing or convalescent home; and WHEREAS, a portion of such property is already used for such purpose by the Martha Jefferson House, as a preexisting nonconforming use: and WHEREAS, such application has been duly advertised as provided by law and has been the subject of a public hearing jointly held by this Council and the City Planning Commission on April 10, 1979; and WHEREAS, the City Planning Commission has recommended approval of such special permit, now, therefore, be it • RESOLVED by the Council of the City of Charlottesville, Virginia, that: 0 (1) The property, located in a R-3 Residential District, on 15th Street, N. W. , designated as Parcel 16 on City Real Property Tax Map'9, is hereby granted a special .permit for use as a nursing or convalescent home, without limitation as to maximum number of residents, -'as permitted under §31-28 of the City Code. (2) The Council finds that such use conforms to the require- ments for special permits generally- imposed by Article XX (§31-218 et seq.) of Chapter, 31 of t1ld City Code;. and this permit is subject to all conditions .and restrictions imposed generally by such article: (3) Such special permit shall be conditioned upon development of the property in accordance with the site plan submitted with the special permit applica'tion,`'as modified by the Planning Commission and finally approved by the Director of Planning.
