• RESOLUTION GRANTING A SPECIAL PERMIT FOR THE USE OF PROPERTY LOCATED AT >'- McINTIRE ROAD AND HARRIS STREET AS A PUBLIC UTILITY FACILITY. W-WREAS,.,-the City of Charlottesville has,applied for a special -permit to use a portion of the property owned :by .it, at the intersectiori of McIntire Road and Harris Street, designated as Parcel 134.1` on City Real, Property Tax Map 35, as a public utility'., lity,, specifically, a central ' community facility for. the collection of used glass, aluminum, paper and -other-recyclable materials; and WHEREAS, such application has been duly advertised as provided by law, and has been the subject of a public hearing .jointly field by this Council and the City Planning Commission on January 9; 19:•79; and.. WHEREAS, the City.Planning Commission has recommended .. approval -of such special` permit, now, -therefore, be'it - RESOLVED by the Council of the City of Charlottesville; Virginia, that: • (1) The property located at the intersection of McIntire Road 1 and Harris Street, 'designated as Parcel 134.1 on City Real Property Tax.Map 35, is hereby granted a special permit for use as a public utility facility, specifically a community recycling center, as permitted under Section 31- 14 of the City Code. (2) The Council finds that such use conforms to the require-ments for special permits generally imposed by Article XX (Section 31-218 et'seq.) of Chapter 31 of the City Code, and this permit is subject to all -conditions, and restrictions, generally by such article: (3) Such special permit shall be conditioned uwl pon deveLopment of the property in accordance with the site plan submitted with the special permit application, ;as modified and finally approved by the Planning, Commission or Director of Plannind, as the case 'may' b . 2 „'.
