A RESOLUTION GRANTING A'SPECIAL PERMIT FOR THE USE, OF PROPERTY LOCATED AT THE INTERSECTION OF SMITH STREET AND ST. CLAIR AVENUE AS A PUBLIC UTILITY FACILITY. WHEREAS, Virginia Electric and Power Company has applied for . a special permit to use property owned by it, at the intersection of Smith Street and St. Clair Avenue, designated as.Parcel 225 on City Real Property Tax Map 49, for expansion of the existing sub -station located on said property; and WHEREAS such application has been duly advertised as provided bylaw, and has been the subject of a public hearing ,,jointly held by this Council and the City Planning Commission on January 8.; 1980; and WHEREAS, the City Planning Commission has recommended approval of such,special,permit, now, therefore; be it RESOLVED by the Council of the City of Charlottesville, Virginia, that: (1) -The property located at the -intersection of Smith Street and St. Clair Avenue, designated'as.Parcel 225 on City Real Property Tax Map 49,,is hereby granted a'special permit for use as a public utility facility, specifically the expansion of the existing sub -station, as permitted under 531-14 of the City Code. (2) The.Council finds that.such use conforms to the require ments for special permits generally imposed by Article XX (531 -218 - et seq.) of Chapter 31 of the City Code; and this permit is subject to all conditions and restrictions imposed generally by such article.' - (3) Such. -special permit shall be conditioned upon develop- ment of the property in accordance with the site plan submitted with the special permit application,'as conditioned by the Planning Commission and finally approved by the Director of Planning.
