A RESOLUTION <br />GRANTING A SPECIAL PERMIT <br />FOR THE.USE OF PROPERTY LOCATED AT <br />600 CHERRY AVENUE <br />AS A RESTAURANT WITH DRIVE-IN WINDOW. <br />WHEREAS, J. R. N. Chicken Stores, Inc. has applied for a <br />special permit to use. property owned by it located at 600 Cherry <br />Avenue in a B-2 Business District as a restaurant with drive-in <br />window; and <br />WHEREAS, such application has been dulyadvertised as <br />provided by law, and has been the subject of a public hearing <br />jointly held by this Council and the City Planning Commission on <br />February 10, 1981; and <br />WHEREAS, the City Planning Commission has recommended <br />approval of such special permit, now, therefore, be it <br />RESOLVED by the Council of the City of Charlottesville, <br />Virginia, that: <br />• 1. That portion of City Real Property Tax Map <br />Parcel 29-233.3 presently located in a B-2 <br />Business District,,at 600 Cherry Avenue, is <br />hereby granted a special permit for use as <br />a drive-in restaurant as permitted under <br />§31-86 of the City Code. <br />2. The Council finds that such use conforms <br />to the requirements for special permits <br />generally imposed by Article XX.(§31-218 <br />et seq.) of Chapter 31 of the City Code <br />and this permit is subject to all conditions <br />and restrictions imposed generally by such <br />article. <br />3. Such special permit shall be conditioned <br />upon development of the property in accor- <br />dance with the site plAn, as conditioned by <br />the Planning tommission and finally approved <br />by the Director of Planning. <br />q, Tae applicant is requested`to consider reducing the <br />• size of the"presently hon -conforming -freestanding <br />sign on the-proper.ty=by at -least -thirty -per cent, as <br />provided'=by :Sectionc31-.176-1-of- the ,City Code: <br />
