0 <br />• <br />E <br />U <br />THIS DEED, made this 16th day of March, 1981, by and between <br />the CITY OF CHARLOTTESVILLE, a municipal corporation, Grantor, <br />hereinafter referred to as the City, party of the first part; and <br />WILLIE SHELTON and CATHERINE SHELTON, hereinafter referred to as <br />Grantees, parties of the second part. <br />WITNESSETH: <br />That for and in consideration of the sum of $5.00 and other <br />good and valuable consideration, the receipt of which is hereby <br />acknowledged, the City hereby GRANTS and CONVEYS unto Grantees <br />a perpetual easement and right-of-way to construct, replace, <br />maintain and repair a sanitary sewer service line on city propert <br />comprising a part of Booker T. Washington Park, as shown on plat <br />of William Morris Foster, C.L.S., dated March 12, 1981, which is <br />attached to and made a part of this deed. Such easement and <br />right-of-way are for a width of six feet on either side of the <br />center line shown on the aforesaid.plat, and include the right to <br />connect such sanitary sewer service line to the existing sanitary <br />sewer main located on the city property which is subject to this <br />easement, as shown on such plat. <br />Such city property subject to this easement was conveyed to <br />the City by deed of Archie S. and Mary Preston Spears, et al., <br />by deed dated January 4, 1955, of record in the Clerk's Office of <br />the Circuit Court of the City of Charlottesville in Deed Book 181, <br />at page 310. Reference is hereby made to the aforesaid deed and <br />to a plat of the City Engineering Department recorded therewith, <br />for a more complete description of such property. <br />Such easement and right-of-way are conveyed to the Grantees, <br />their heirs and assigns, for the benefit of the property of <br />Grantees lying to the northeast of said city property, but not <br />immediately adjacent thereto, being the same property which was <br />conveyed to Willie Shelton and Catherine Shelton by deed of gift <br />from Maggie Shelton dated November 22, 1954, of record in the <br />aforesaid Clerk's Office in Deed Book 180, at page 339, and more <br />particularly described on a plat of C. H. Shapleigh recorded with <br />such deed of gift in Deed Book 180, at page 340. Said property <br />which this easement is intended to benefit is also known and <br />designated as Parcel 90.1 on City Real Property Tax Map Sheet 3. <br />IN WITNESS WHEREOF the City of Charlottesville has caused <br />this deed to be signed by its Mayor and its seal affixed and <br />attested by the Clerk of the Council, pursuant to a resolution <br />of City Council duly adopted on 1981. <br />CITY OF CHARLOTTESVILLE <br />BY (SEAL) <br />Francis L.
