0 • E U THIS DEED, made this 16th day of March, 1981, by and between the CITY OF CHARLOTTESVILLE, a municipal corporation, Grantor, hereinafter referred to as the City, party of the first part; and WILLIE SHELTON and CATHERINE SHELTON, hereinafter referred to as Grantees, parties of the second part. WITNESSETH: That for and in consideration of the sum of $5.00 and other good and valuable consideration, the receipt of which is hereby acknowledged, the City hereby GRANTS and CONVEYS unto Grantees a perpetual easement and right-of-way to construct, replace, maintain and repair a sanitary sewer service line on city propert comprising a part of Booker T. Washington Park, as shown on plat of William Morris Foster, C.L.S., dated March 12, 1981, which is attached to and made a part of this deed. Such easement and right-of-way are for a width of six feet on either side of the center line shown on the aforesaid.plat, and include the right to connect such sanitary sewer service line to the existing sanitary sewer main located on the city property which is subject to this easement, as shown on such plat. Such city property subject to this easement was conveyed to the City by deed of Archie S. and Mary Preston Spears, et al., by deed dated January 4, 1955, of record in the Clerk's Office of the Circuit Court of the City of Charlottesville in Deed Book 181, at page 310. Reference is hereby made to the aforesaid deed and to a plat of the City Engineering Department recorded therewith, for a more complete description of such property. Such easement and right-of-way are conveyed to the Grantees, their heirs and assigns, for the benefit of the property of Grantees lying to the northeast of said city property, but not immediately adjacent thereto, being the same property which was conveyed to Willie Shelton and Catherine Shelton by deed of gift from Maggie Shelton dated November 22, 1954, of record in the aforesaid Clerk's Office in Deed Book 180, at page 339, and more particularly described on a plat of C. H. Shapleigh recorded with such deed of gift in Deed Book 180, at page 340. Said property which this easement is intended to benefit is also known and designated as Parcel 90.1 on City Real Property Tax Map Sheet 3. IN WITNESS WHEREOF the City of Charlottesville has caused this deed to be signed by its Mayor and its seal affixed and attested by the Clerk of the Council, pursuant to a resolution of City Council duly adopted on 1981.
