TO ADD A `IZW <br />SECTION NUMBERED 21-4.L RELATING TO THE <br />DISSEMINATION OF CRLMINc_L HTSTOR`_' <br />RECORD INFORTAT10N <br />• <br />0 <br />3E IT ORDAINED by the Council of the CiZ7 of Charlottesville, <br />Virginia, that Article I of Chapter 21 of the Code of _he City of <br />Charlottesville, 1976, as amended, is amended and reordained to <br />add a new Section 21-4.1, as follows: <br />Section 21-4.1. Dissemination of criminal histor;,r <br />record information. <br />(a) Pursuant to the authority of section 19.2-389A(vii) of <br />the Code of Virginia, 1950, as amended, the chief of police and <br />any designee of the chief are hereby authorized and directed to <br />request criminal history record information from the Central <br />Criminal Records Exchange, a division of the Virginia Department <br />of State Police, on behalf of the city manager or the director <br />of personnel who requests such information in order to complete <br />an investigation of an applicant for city employment or an <br />applicant for a permit or license, whenever, in the judgment <br />of the city manager or director of personnel, it is necessary <br />in the interest of public welfare or safety to determine whether <br />the past criminal conduct of an individual with a conviction <br />record would be compatible with the nature of the employment, <br />permit or license under consideration. <br />(b) Criminal history record information received by the <br />police department from the Central Criminal Records Exchange <br />for the purpose stated in subsection (a) of this section, as <br />well as criminal history record information from city police <br />files, if such information is requested for tae same purpose, <br />shall be transmitted in confidence to the requesting official <br />with Cie.ar instructions as to the limited our -Dose --or whicn <br />such information may be used.
