0 <br />ot <br />Copy Teste: <br />Clerk of Council <br />A RESOLUTION <br />GRANTING A SPECIAL PERMIT <br />OF PROPERTY LOCATED <br />812 RIVES STREET <br />FOR A GROUP HOME FOR THE ELDERLY <br />THAN TEN PEOPLE <br />Adopted by Council <br />January 5, 1981 <br />FOR THE USE <br />AT <br />HOUSING NOT MORE <br />ATHEREAS, Jane L. Holt has applied for a special permit for <br />use of her property located at 812 Rives Street in an R-2 <br />Residential District, for a group home for the elderly housing_ <br />not more than ten persons; and <br />WHEREAS, such application has been.duly advertised as <br />provided by law and has been the subject.of public hearings held <br />by the City Planning Commission on December 9, 1980 and by City <br />Council on January 5, 1981; and. <br />WHEREAS, the City Planning Commission has recommended approval <br />of such special permit; now, therefore, 'be it <br />RESOLVED by the Council of'the City bf Charlottesville, <br />Virginia that: <br />1. The property located in;an R-2 Residential District <br />at 812 Rives Street, designated as Parcel 85 on City <br />Real Property Tax Map 61 is hereby granted a special <br />permit for use as a group home for the elderly <br />housing not more than ten persons, as permitted <br />under §§31-14 and 31-21 of the City Code. <br />2. The Council finds that such use conforms to the <br />requirements for special permits generally imposed <br />by Article XX (§31-218 et. seq.) of Chapter 31 of <br />the City Code, and this permit is subject to all <br />conditions and restrictions imposed generally by <br />such article. <br />3. Such special permit shall be conditioned upon <br />development of the property in accordance with the <br />site plan submitted with the special permit <br />application, including conditions imposed by the <br />Planning Commission, and as finally approved by the <br />Director of Planning, including the construction <br />of required drainage measures, sidewalks not waived <br />by the Planning Commission, surface treated parking, <br />access for the handicapped, .recreational areas and.. <br />screening_ at the southeast end of the property <br />adjacent to single family residential uses. <br />
