AN ORDINANCE <br />TO AMEND AND REORDAIN SECTION 15-90 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, <br />1976, AS AMENDED, TO REQUIRE RESTAURANT <br />OPERATORS TO PRESENT A VALID HEALTH <br />DEPARTMENT LICENSE BEFORE OBTAINING A LOCAL <br />BUSINESS LICENSE. <br />BE IT ORDAINED by the Council of the City of Charlottes- <br />ville, Virginia, that §15-90 of the Code of the City of <br />Charlottesville, 1976, as amended, is hereby amended to read <br />as follows: <br />Section 15-90. Restaurants. <br />(a) Any person who shall cook or otherwise furnish for <br />compensation, diet or refreshments of any kind, for casual <br />visitors at his or her home or place of business, for consump- <br />tion therein or thereat, or any person who shall sell soft <br />drinks from a soda fountain, shall be deemed to keep a restaur- <br />ant. On every license to keep a restaurant, the tax shall be <br />calculated on the same basis as in the case of a retail merchant <br />as provided in section 15-72 of this Code. <br />' (b) Where any person qualifies as a keeper of a restaurant <br />under this section and as a retail merchant under section 15-72 <br />of this Code, in the same place of business, the total sales <br />shall be computed for the purpose of arriving at the tax. <br />(c) The commissioner of the revenue shall not issue a <br />business license for keeping a restaurant until the owner or <br />operator has presented a valid license from the health depart- <br />ment to chapter 3 of title 35.1 of the Code of <br />i <br />Virgniaiss, 1950, as amended. <br />(d) Every restaurant keeper shall keep accurate daily <br />records of all sales, which records shall at all times be open <br />to the inspection of by the commissioner of the revenue or the <br />license inspector. <br />Adopted by Council <br />November 2, 1931 <br />AEteste: <br />Clerk of Council <br />
