• THIS LICENSE AND PERMIT, made and entered into this 7th day of December, 1981 by and between the CITY OF CHARLOTTESVILLE, VIRGINIA, a municipal corporation, Grantor, and VIRGINIA NATIONAL BANK, Grantee. WITNESSETH: WHEREAS, Grantee is the owner of property located at the northeast corner of Third and Water Streets in the City of Charlottes- ville, upon which Grantee wishes to install decorative landscaping, a brick wall, and other improvements and WHEREAS, the design_of Grantee's proposed brick wall and other decorative improvements necessitates that they encroach upon the public right-of-way of Water Street; and WHEREAS, the public will benefit from the beautification of this property on a major thoroughfare of the City; NOW, THEREFORE, in consideration of the sum of FIVE DOLLARS ($5.00) and the aforesaid public benefits, the City of Charlottesville hereby grants to Virginia National Bank and its successors in title to the property located at the northeast corner of Third and Water Streets revocable license and permission to construct a brick wall and install brick paving within the public right-of-way along the Water •Street frontage of that property and around the city bus stop shelter located on that corner. Such wall and paving shall be installed in a workmanlike manner in accordance with plans dated September 30, 1981 prepared by Van Yahres Associates, A.S.L.A., a copy of which shall be kept on file in the office of the Clerk of the Council, with the papers of the meeting at which this license was granted. In no event shall such encroachment extend into the public right-of-way a distance greater than four feet. By its acceptance and recordation of this instrument Grantee agrees to maintain the wall and other improvements on the public right- of-way in good repair at all times and to indemnify the City, its officers and employees from all claims for 'damages of any nature arising out of Grantee's exercise of the rights herein granted. Grantee further agrees that it will remove all encroachments herein permitted at any time upon sixty days' written notice mailed or delivered to Grantee's successor in title. IN WITNESS WHEREOF, the City has caused this instrument to be executed by its Mayor, and its seal affixed and attested by its Clerk of the Council, pursuant to a resolution of City Council duly adopted at a regular meeting on December 7, 1981. • CITY OF CHARLOTTESVILLE BY Francis L.
