WHEREAS, over 50 years ago a certain building known as <br />512 Rives Street located on tax parcel 86, tax map 56, fronting <br />on Fives Street in the city was inadvertently constructed <br />partially in said street; and <br />WHEREAS, the owners of said parcel, Joyce P. Lively and <br />Julius L. Lively, Jr., have contracted to sell said parcel and <br />imp ovements to Jane M. Plumb; and <br />WHEREAS, Jane M. Plumb seeks certain assurances concerning <br />said improvemen's before she is willing to compete said purchase; <br />and <br />WHEREAS, said structures do not impede the flow of traffic <br />on Rives Street; and <br />WHEREAS, the City has no need to compel the removal of said <br />struc cures ; <br />NOW THEREFORE, BE IT RESOLVED, that the City Council declsses <br />that it will not compel the removal o,`. said structures unless <br />they are damaged by fire or other natural causes to the extent <br />of 50% of their fair market value as of the time said damage is <br />sustained. <br />AND BE IT FURTHER RESOLVED, that the owners of said tax <br />. parcel 86, tax map 56, known as 5]2 Rives Street and their <br />successors in title have a license and permission to have said <br />improvements remain as presently located for so long as they <br />stand provided that said improvements are not damaged by fire <br />or other natural causes to the extent of 50% of their fair market <br />value as of the time said damage is sustained. <br />ADOPTED BY COUNCIL <br />JANUARY 19, 1982 <br />ATTESTE: <br />CLERK OF COUNCIL <br />
