at locations and In such manner as Licensor may direct. Licensee shall leave Llcensor's property In a condition
<br />satisfactory to Licensor.
<br />8. Licensee agrees to make such tests as in the Judgment of Licensor are necessary to determine if Opera-
<br />tion, existence, maintenance or use of said Crossing or protection provided therefor against corrosion, causes inter-
<br />ference with any of Licensor's facilltles whatsoever. Licensee further agrees, upon written notice from Licensor of
<br />such Interference, to make such changes as may be necessary to eliminate said interference.
<br />9. No cathodic protection system shall be Installed which will cause electric current to flow across or along
<br />Licensor's property without prior written authorization of Licensor. Any authorized cathodic protection system shall
<br />be installed and maintained by Licensee, at Its sole cost and expense, In such manner so as to preclude Interference
<br />with Licensor's electrical systems and so as not to cause any deterioration of Licensor's structures In service or
<br />hereafter installed. The terms and conditions of this Agreement shall apply to the constructlon, maintenance, repair,
<br />removal, presence or use of said cathodic protection system.
<br />10. Licensee, at its sole cost and expense, shall erect and thereafter maintain signs showing location and
<br />depth of underground Crossing. Such signs shall be In conformity with Exhibit A, "Signs for Marking Underground
<br />Facilities", attached hereto and made a part hereof, or as approved by Licensor.
<br />11. If, at any time hereafter, Licensor shalldeslreto make any change, relocation or Improvement In Its track,
<br />structures, roadbed or other installation and facilities at said location of Crossing or make any changes whatever In,
<br />to, upon, over or under its property and In any way used or affected by Crossing, Licensee, upon thirty (30) days'
<br />written notice to that effect from Licensor, shall make such change In the location or construction of Crossing, at
<br />• Licensee's sole cost and expense and in accordance with plans satisfactory to Licensor.
<br />12. If Licensee desires to revise, renew, relocate or change in any manner whatsoever all or any part of said
<br />Crossing (Including any change In pipe diameter or operating pressure), or If Licensee Is required to change or
<br />alter Crossing, plans therefor shall be submitted to Licensor for approval before any such change is made, and the
<br />terms and conditions of this Agreement shall apply thereto after Licensor's approval.
<br />13. If Licensor deems It advisable, during the progress of any construction, maintenance, repair, renewal, al-
<br />teration, change or removal of said Crossing, to place watchmen, flagmen, inspectors or supervisors for protection
<br />of operations of Licensor or others on Licensor's property at the aforesaid location, Licensor shall have the right to
<br />do so at the expense of Licensee, but Licensor shall not be liable for Its failure to do so or the failure or neglect of
<br />such watchmen, flagmen, inspectors or supervisors.
<br />14. Nothing herein contained shall be construed to permit Licensee or Licensee's contractor to move any
<br />vehicles or equipment over track of Licensor without separate prior written approval of Licensor except at public
<br />road crossing.
<br />15. Licensee shall not at any time own or claim any right, title or Interest In or to Licensor's property occu-
<br />pied by Licensee's Crossing, nor shall the exercise of this Agreement for any length of time give rise to any right,
<br />title or interest In Licensee to said property.
<br />16. Upon execution of this Agreement, Licensee shall pay Licensor:
<br />(a) The sum of * * * * * * * * ONE HUNDRED DOLLARS ($100.00 ) toward
<br />the cost of preparing this Agreement; and
