RESOLUTION GRANTING A SPECIAL PERMIT FOR THE USE OF • PROPERTY LOCATED IN THE McINTIRE PLAZA SHOPPING CENTER AS AN ANIMAL HOSPITAL WITHOUT OUTSIDE RUNS OR PENS. WHEREAS, Dr. Charles H. Wood, Jr., has applied for a special permit to use property owned by Allied Realty, Inc. and leased by Dr. Wood, located in the McIntire Plaza Shopping Center in a B-3 Business District, as an animal hospital without outside runs or pens; and WHEREAS, such application has been duly advertised as pro- vided by law and has been the subject of a public hearing jointly held by this Council and the City Planning Commission on June 8, 1982; and WHEREAS, the City Planning Commission has recommended approval of such special permit, now, therefore, be it RESOLVED by the Council of the City of Charlottesville, Virginia, that: 1. The area of the McIntire Plaza Shopping Center contain- ing 925 square feet of floor area known as 1707 Allied Lane, presently located in a B-3 Business District, and being a portion of City Real Property Tax Map Parcel 34-90.9, fronting on Allied Street and McIntire Road, is hereby granted a special permit for use as a animal hospital without outside runs or pens as per- mitted under §31-93 of the City Code. 2. Council finds that such use conforms to the requirements for special permits generally imposed by Article XX (§31-218 et seq.) of Chapter 31 of the City Code, and this permit is subject to all conditions and restrictions imposed generally by such article. 3. Such special permit shall be conditioned upon develop- ment and use of the property in accordance with the site plan, as conditioned by the Planning Commission and finally approved by the Director of Planning, and failure to adhere to the require- ments of the site plan shall be deemed cause for revocation of this special permit.
