RESOLUTION <br />GRANTING A SPECIAL PERMIT FOR THE USE OF <br />• PROPERTY LOCATED IN THE McINTIRE PLAZA SHOPPING CENTER <br />AS AN ANIMAL HOSPITAL WITHOUT OUTSIDE RUNS OR PENS. <br />WHEREAS, Dr. Charles H. Wood, Jr., has applied for a special <br />permit to use property owned by Allied Realty, Inc. and leased by <br />Dr. Wood, located in the McIntire Plaza Shopping Center in a B-3 <br />Business District, as an animal hospital without outside runs or <br />pens; and <br />WHEREAS, such application has been duly advertised as pro- <br />vided by law and has been the subject of a public hearing jointly <br />held by this Council and the City Planning Commission on June 8, <br />1982; and <br />WHEREAS, the City Planning Commission has recommended <br />approval of such special permit, now, therefore, be it <br />RESOLVED by the Council of the City of Charlottesville, <br />Virginia, that: <br />1. The area of the McIntire Plaza Shopping Center contain- <br />ing 925 square feet of floor area known as 1707 Allied Lane, <br />presently located in a B-3 Business District, and being a portion <br />of City Real Property Tax Map Parcel 34-90.9, fronting on Allied <br />Street and McIntire Road, is hereby granted a special permit for <br />use as a animal hospital without outside runs or pens as per- <br />mitted under §31-93 of the City Code. <br />2. Council finds that such use conforms to the requirements <br />for special permits generally imposed by Article XX (§31-218 et <br />seq.) of Chapter 31 of the City Code, and this permit is subject <br />to all conditions and restrictions imposed generally by such <br />article. <br />3. Such special permit shall be conditioned upon develop- <br />ment and use of the property in accordance with the site plan, as <br />conditioned by the Planning Commission and finally approved by <br />the Director of Planning, and failure to adhere to the require- <br />ments of the site plan shall be deemed cause for revocation of <br />this special permit. <br />Atteste: <br />Clerk of Council <br />• <br />Adopted by Council <br />June 21, 1982 <br />
