RESOLUTION <br />• AUTHORIZING THE RETENTION <br />OF SPECIAL LEGAL COUNSEL <br />WHEREAS, the Council has been served with a Motion for <br />Judgment in a lawsuit styled Martin H. Dehaan, et al. v. City <br />of Charlottesville, et al. pending in the Circuit Court for the <br />City of Charlottesville (Case No. 2929) challenging, among other <br />matters, the ordinance of October 27, 1983, authorizing the <br />issuance of $9.5 million in general obligation bonds and bond <br />anticipation notes, the proceeds of which are to be appropriated <br />to the Charlottesville Redevelopment and Housing Authority (CRNA), <br />for use in the Vinegar Hill Redevelopment Project; and <br />WHEREAS, on advice of the City Attorney, the Council has <br />determined that the public interest requires that the firm of <br />Little, Parsley and Cluverius of Richmond, Virginia, who have <br />previously been retained as special counsel to the City and CRHA, <br />be retained as defense counsel in this litigation; now therefore <br />be it <br />RESOLVED, by the Council of the City of Charlottesville, <br />Virginia that the City Attorney is authorized and directed to <br />• retain the firm of Little, Parsley and Cluverius, at the firm's <br />usual and customary hourly rates, for the defense of the City <br />and the Council in the case of Martin H. Dehaan, et al. v. City <br />of Charlottesville, et al. and related matters, including such <br />expert witnesses or other ancillary services as may be required, <br />and further including the filing of any counterclaims, cross- <br />claims or third party motions the City Attorney deems advisable; <br />and be it further <br />RESOLVED, that CRHA is requested and authorized to pay the <br />expenses of this litigation from the account of the Vinegar Hill <br />Project, including funds transferred to that account from the <br />Garrett Street Redevelopment Project account pursuant to previous <br />action of this Council. <br />Approved by Council <br />December 5, 1983 <br />Clk � `-��4 <br />0 <br />
